RESOLUTION OF INTENTION TO ANNEX TERRITORY TO COMMUNITY FACILITIES DISTRICT NO. 1992-1 AND TO LEVY A SPECIAL TAX COMMUNITY FACILITIES DISTRICT NO. 1992-1 CITY OF REDDING COUNTY OF SHASTA, STATE OF CALIFORNIA The City Council of the City of Redding resolves: 1 . This Council hereby determines that the public convenience and necessity require the annexation of additional parcels of land to Community Facilities District No. 1992-1 ("CFD 1992-1 "). The parcels of land to be annexed are listed on Exhibit A, attached hereto and shown on the Annexation Map approved by this Council's Resolution No. 95-12 adopted this same date. Copies are available for inspection at the City Clerk's Office. The Council finds that this annexation is to the advantage of the City of Redding and the owners of property within CFD 1992-1 . 2. CFD 1992-1 is authorized to finance certain services, and no change is proposed in this regard. 3. The area to be annexed shall be subject to special tax, from the time of its inclusion in CFD 1992-1, under the rate and method of apportionment contained in the Resolution of Formation of CFD 1992-1,our Resolution No. 92- 493, adopted December 15, 1992. This special tax will be secured by the recordation of a continuing lien against all non-exempt real property in the area to be annexed. 4. No alteration of the rate and method of apportionment of special tax is contemplated by these proceedings as pertains to the area already within CFD 1992-1 . 5. This Council hereby sets Tuesday, February 14, 1995, at 7:00 p.m., in the Council Chambers at 1313 California Street, Redding, California 96001 , as the time and place for the public hearing on this Resolution. At that hearing, the testimony of all interested persons for or against the annexation of territory to CFD 1992-1 or the levying of special taxes within the area proposed to be annexed will be heard. Written protests filed with the City Clerk prior to the time set for the hearing by the owners of a majority of the land area subject to special tax within the current boundaries of CFD 1992-1, or filed by the owners of a majority of the land area to be subject to special tax in the area to be annexed, will require suspension of these annexation proceedings for at least one year as to all issues discussed at the hearing. Written protests must be filed with the City Clerk at or before the time fixed for the hearing. If such protests are directed only against certain elements of the proposed services or proposed special tax, only those elements shall be deleted from the proceedings. 6. In the event an election is held in these annexation proceedings, it is anticipated that, in accordance with the Mello-Roos Community Facilities Act of 1982, the voters will be the owners of land within the area proposed to be annexed which will be subject to the special tax, with each landowner eligible to cast one vote for each acre or portion of an acre owned therein. It is anticipated that the election, pursuant to statutory waivers, may take place at the close of the public hearing. 7. The City Clerk is hereby directed to mail copies of this Resolution to all owners of property proposed to be annexed at their addresses as shown on the County Assessor's current records, or more recent addresses if know to the City Clerk. 8. The City Clerk is further directed to arrange for publication of this Resolution one time in the Redding Record-Searchlight not less than 10 days prior to the hearing.
