RESOLUTION NO. 95-_10
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDDING
APPROVING THE REPORT OF THE ENGINEER, AS FILED; AND DECLARING
ITS INTENTION TO ANNEX ADDITIONAL TERRITORY, NAMELY FOREST
HOMES ESTATES SUBDIVISION, PHASE 3 (AREA 7) , INTO LANDSCAPE
MAINTENANCE DISTRICT "C," AND TO LEVY AND COLLECT ASSESSMENTS.
IN SAID DISTRICT FOR FISCAL YEAR 1995-96 PURSUANT TO THE
LANDSCAPING AND LIGHTING ACT OF 1972, COMMENCING WITH SECTION
22500 OF THE STREETS AND HIGHWAYS CODE.
WHEREAS, on this date the City Council adopted its resolution
stating that no new improvements or substantial changes in existing
improvements in Landscape Maintenance District "C" are proposed for
fiscal year 1995-96, and ordering the Engineer to prepare and file a
report pursuant to Streets and Highways Code Section 22565, et seq. ;
and
WHEREAS, the Engineer has filed his Report with the City Clerk;
and
WHEREAS, a public meeting will be held May 2 , 1995, pursuant to
Section 54954. 6 of the Government Code;
NOW, THEREFORE, IT IS HEREBY RESOLVED by the City Council of the
City of Redding as follows:
1 . The City Council hereby approves the Report of the Engineer, as
filed.
2 . It is the intention of the City Council to:
( a) annex additional territory into Landscape Maintenance
District "C" (District) , namely Forest Homes Estates
Subdivision, Phase 3 (Area 7) ; and
(b) levy and collect assessments for fiscal year 1995-96 equally
amongst all the lots and remaining parcels that encompass the
District, including the area proposed to be annexed in, which
lots and parcels are more particularly described in the
location maps and summary attached hereto and made a part
hereof , except that it shall not impose an assessment upon a
federal or state governmental agency or another local agency.
3 . Only costs for the maintenance of landscaping, repairs to the
vegetation as necessary, and any and all incidental expenses,
including administrative costs, in connection therewith will be
assessed.
4 . The lots and parcels in the District are generally located as set
forth in the attached summary.
5. The Report of the Engineer, on file with the City Clerk, contains
a full and detailed description of the improvements; the
boundaries of the District, including the area proposed to be
annexed in, and any zones therein; any bonds or notes to be
issued; and the proposed assessments upon the assessable
lots/remaining parcels within the District.
6 . A public meeting will be held on Tuesday, May 2, 1995, and a
public hearing on Tuesday, May 16, 1995, each at the hour of 7 : 00
p.m. or as soon thereafter as the matter may be heard, in the City
Council Chambers located at 1313 California Street, Redding,
California, to address the levy of the proposed assessment for
fiscal year 1995-96.
7 . The assessment is proposed to increase from the previous year.
I HEREBY CERTIFY that the foregoing Resolution was introduced,
read, and adopted at a regular meeting of the City Council on the 21st
day of March, 1995, by the following vote:
