RESOLUTION NO. 95-
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDDING
SUMMARILY VACATING THE PUBLIC USE EASEMENT OR RIGHT-OF-
WAY GRANTED TO THE CITY OF REDDING WITH THE RECORDING
OF AN AIR EASEMENT FROM DONALD LYNN AND DARLENE LYNN ON
MAY 21, 1993, IN BOOK 3006 AT PAGE 65, SHASTA COUNTY
RECORDS; DOCUMENT NO. 22138.
WHEREAS, on January 5, 1993 , DONALD LYNN and DARLENE LYNN
granted to the City of Redding and the Enterprise Flying Club,
Inc. , a California corporation, and their successors and assigns,
forever, a perpetual public use easement or right-of-way for the
free and unobstructed passage and flight of aircraft, of whatever
ownership and whether now known or hereafter used for navigation
of or flight in the air, in, through, over and across the air
space 250 feet or more above ground level of the parcel of real
property more particularly described in Exhibit A" attached
hereto and made a part hereof (hereinafter referred to as
"Easement" ) ; and
WHEREAS, the City has been advised that the Enterprise
Airpark, for which the Easement was granted, has been abandoned,
and the airport facilities removed; and
WHEREAS, the Public Works Department has duly investigated
this matter, and has advised the City Council that the Easement
has been superseded due to the removal of the airport facilities,
and that there are no other public facilities located within the y�
Easement;
NOW, THEREFORE, the City Council of the City of Redding
hereby RESOLVES and ORDERS as follows:

1 . The City Council elects to proceed in this: matter under the
provisions of the Public Streets, Highways, and Service
Easements Vacation Law as the same is set forth in Section
8330 , et seq. , of the Streets and Highways Code of the State
of California.
2 . That the public use easement or right-of-way granted to the
City of Redding with the recording of an Air Easement from
DONALD LYNN and DARLENE LYNN on May 21, 1593 , in Book 3006
at page 65, Shasta County Records, under No. 22138, is no
longer necessary and is hereby vacated.
3 . This summary vacation is based upon the fact that said
Easement is no longer required because the Enterprise
Airpark, for which the Easement was granted, has been
abandoned and there are no other public facilities located
within the Easement.
4. The City Clerk is hereby directed to record a certified copy
of this resolution of vacation, attested by the Clerk under
seal, in the office of the Shasta County Assessor/Recorder.
5 . From and after the date this resolution is recorded, the
Easement hereby vacated no longer constitutes a public
service easement.
I HEREBY CERTIFY that the foregoing Resolution was
introduced, read, and adopted at a regular meeting of the City
Council on the 4th day of April , 1995, by the following vote:
