RESOLUTION NO. 95-
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDDING:
(1) INITIATING PROCEEDINGS TO ANNEX ADDITIONAL
TERRITORY, NAMELY FOREST HOMES ESTATES SUBDIVISION,
PHASE 3 (AREA 7) , INTO LANDSCAPE MAINTENANCE
DISTRICT "C";
(2) STATING THAT NO NEW IMPROVEMENTS OR SUBSTANTIAL
CHANGES IN EXISTING IMPROVEMENTS ARE PROPOSED FOR
FISCAL YEAR 1995-96; AND
(3) ORDERING THE ENGINEER TO PREPARE AND FILE A REPORT
PURSUANT TO SECTION 22622, ET SEQ. , OF THE STREETS
AND HIGHWAYS CODE.
WHEREAS, with respect to Landscape Maintenance District "C" as
it now exists:
A. The City Council heretofore ordered the consolidated
formation of Landscape Maintenance District "C" under
authority granted by the Landscaping and Lighting Act of
1972, as set forth in Part 2 of Division 15 of the
Streets and Highways Code of the State of California.
B. The purpose of the landscape maintenance district is to
provide maintenance to those landscaping improvements
required within the public rights-of-way by the
conditions of development approval of the subdivision.
C. only costs for the maintenance of landscaping, repairs to
the irrigation system, electric and water charges,
replacement of vegetation as necessary, and any and all
incidental expenses, including administrative costs, in
connection therewith will be assessed; and
D. No new improvements or substantial changes in existing
improvements are proposed for fiscal year 1995-96; and
WHEREAS, with respect to the additional territory proposed to
be annexed into the District:
A. On February 7 , 1995, a Petition and Consent for the
annexation of additional territory into Landscape
Maintenance District "C" and to the levy and collection
of assessments, signed by the owner of the land as shown
on the last equalized County assessment roll—or entitled
to be shown as owner on the next County assessment roll—
or where any of said property is subject to a recorded
written agreement of sale, is shown therein as
purchaser—was filed with the City Clerk of the City of
Redding pursuant to the Landscaping and Lighting Act of
1972, Division 15, Part 2 (commencing with Section
22500) , of the Streets and Highways Code of the State of
California, especially Section 22608 thereof.
B. In said Petition, the owner consented to the City Council
conducting its proceedings for annexation without notice
and hearing and without the filing of an engineer' s
report, all in accordance with the Landscaping and
Lighting Act of 1972.
C. The territory proposed to be annexed into Landscape
Maintenance District "C" is described as follows:
All of that certain real property situate in the City of
Redding, Shasta County, California, being Lots 1-58
inclusive of the Forest Homes Estates Subdivision, Phase
3, as shown on the Map recorded February 16, 1995, in
Book 21 of Maps at page 62, Shasta County Records
(previously A.P. No. 110-030-17) .
D. No costs for the original improvements in the additional
territory proposed to be annexed into Landscape
Maintenance District "C" will be assessed against the
District; all such costs of improvements being conditions
of development of the Forest Homes Estates Subdivision,
Phase 3 ;
NOW, THEREFORE, IT IS HEREBY RESOLVED by the City Council as
follows:
1. Pursuant to the Landscaping and Lighting Act of 1972 , the City
Council proposes to annex Forest Homes Estates Subdivision,
Phase 3 (Area 7 ) , into Landscape Maintenance District "C." It
is noted that the owner has consented to the City Council
conducting its proceedings for annexation without notice and
hearing and without the filing of an engineer' s report.

2. As to Landscape Maintenance District "C" as it now exists, no
new improvements or substantial changes in existing
improvements are proposed for fiscal year 1995-96 ; and the
Engineer, JAMES KING, is ordered to prepare and file a report
in accordance with Streets and Highways Code Chapter 1,
Article 4 (commencing with Section 22565) , of Part 2—
Landscaping and Lighting Act of 1972.
I HEREBY CERTIFY that the foregoing Resolution was introduced,
read, and adopted at a regular meeting of the City Council on the
21st day of March, 1995, by the following vote:
