HomeMy WebLinkAboutReso 95-103 - Authorize filing of docs to continue COR Serious Habitual Offender Program • RESOLUTION NO. 95- 163 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDDING AUTHORIZING THE FILING OF THE NECESSARY DOCUMENTATION TO CONTINUE THE CITY OF REDDING SERIOUS HABITUAL OFFENDER (SHO) PROGRAM, FUNDED IN PART FROM FUNDS MADE AVAILABLE THROUGH THE SHO PROGRAM ADMINISTERED BY THE OFFICE OF CRIMINAL JUSTICE PLANNING (OCJP) . WHEREAS, the City Council, on June 15, 1993 , by Resolution 93-241, ratified a Grant Award Agreement between the City of Redding and the Office of Criminal Justice Planning to establish a Serious Habitual Offender (SHO) Program; and WHEREAS, the Office of Criminal Justice Planning requires reapplication each year of the three-year grant process; and WHEREAS, the reapplication process requires a resolution of the City Council authorizing the continuation of participation in the Program; and WHEREAS, the accompanying Report to City Council sets forth the success of the Program and the anticipated availability of funding in fiscal year 1995/96; and WHEREAS, the Chief of Police has recommended the continuation of the CITY OF REDDING SHO PROGRAM, funded in part from funds made available through the Serious Habitual Offender Program administered by the Office of Criminal Justice Planning; IT IS THEREFORE RESOLVED by the City Council of the City of Redding as follows: 1. The City Council hereby authorizes the reapplication for year three of the Serious Habitual Offender Grant; and hereby authorizes the City Manager to execute the necessary documentation and any extensions or amendments thereto. 2. The City of Redding agrees to provide all matching funds required for said Project under the Program �r�l ( including any amendment thereof) and to the funding terms and conditions of the OCJP; and that the cash match will be appropriated as required. R. (A) 3 . It is agreed that any liability arising out of the performance of this Grant Award Agreement, including civil court actions for damages, shall be the responsibility of the grant recipient and the authorizing agency. The State of California and the OCJP disclaim responsibility for any such liability. 4. The grant funds received hereunder shall not be used to supplant expenditures controlled by this body.
