WHEREAS, on March 21, 1995, the City Council approved the Report of the Engineer as filed relating to Landscape Maintenance District "C" (District) , and gave notice of the time and place of the May 16, 1995, public hearing regarding the levy and collection of assessments for fiscal year 1995-96; and WHEREAS, the City Council also gave notice of its intention to annex additional territory, namely the Forest Homes Estates Subdivision, Phase 3, into the District; and WHEREAS, a diagram of the area encompassed by the District, including the area proposed to be annexed in, individual maps, and a summary are attached hereto and made a part hereof; and WHEREAS, the public hearing, duly and properly noticed, commenced at the City Council Chambers, 1313 California Street, Redding, California, on May 16, 1995, and was concluded prior to the adoption of this Resolution; and WHEREAS, at the May 16 public hearing, the City Council gave every interested person an opportunity to object to the proposed annexation of additional territory and the assessment; and WHEREAS, all legal prerequisites to the adoption of this Resolution have occurred, including a public meeting held May 2, 1995, pursuant to Government Code Section 54954. 6; , NOW, THEREFORE, the City Council of the City of Redding does (�J hereby find, resolve, determine, and order as follows: i 1. The matters set forth above are true and correct. �1 2 . With respect to existing Landscape Maintenance District "C," the City Council has considered all oral statements and written protests or communications made or filed by interested persons at 1 the public meeting of May 2, 1995, and the public hearing of May 16, 1995, and hereby expressly overrules any and all protests filed objecting to the proposed assessments to be levied in the District. 3 . With respect to the additional territory proposed to be annexed into Landscape Maintenance District "C" : A. The owner of the land within the boundaries of the additional territory proposed to be annexed into the District has filed his Petition and Consent to said inclusion; and has waived the resolutions, engineer' s report, notices of hearing, and the right of a majority protest with regard to the area proposed to be annexed as provided by Section 22608 of the Streets and Highways Code. B. Said territory is described as follows: All of that certain real property situate in the City of Redding, Shasta County, California, being Lots 1-58 inclusive of the Forest Homes Estates Subdivision, Phase 3, as shown on the Map recorded February 16, 1995, in Book 21 of Maps at page 62, Shasta County Records (previously A.P. No. 110-030- 17 ) . C. The improvements as specified in the Engineer' s Report on file with the City Clerk are hereby ordered to be completed. D. The City Council hereby orders the annexation of said additional territory into Landscape Maintenance District "C" for the installation or construction of improvements and the maintenance and/or servicing thereof, together with any and all incidental expenses and administrative costs in connection therewith, all as more particularly authorized pursuant to the Landscaping and Lighting Act of 1972 . 4. The City Council finds that the Engineer has fairly and properly apportioned the cost of the improvements to each lot/remaining parcel of land in the District (including the Area 7 annexed in) in proportion to the estimated benefits to be received by each lot/remaining parcel from the improvements. 5 . The assessment diagram contained in the Engineer' s Report is hereby adopted and confirmed. 6. The following assessment against each lot and remaining parcel located within the District for fiscal year 1995-96 is hereby adopted and confirmed: 2 .J292PAGE399 Assessment: $12.37 Less credit for cash carryover - 3 . 42 Net payable: $ 8. 95. 7 . The City Clerk shall forthwith transfer to the Auditor and the Assessor/Recorder of Shasta County a certified copy of this Resolution and a certified copy of the assessment diagram contained in the Engineer' s Report. I HEREBY CERTIFY that the foregoing Resolution pertaining to Landscape Maintenance District "C" was introduced, read, and adopted at a regular meeting of the City Council on the 16th day of May, 1995, by the following vote: AYES: COUNCIL MEMBERS: P.
