HomeMy WebLinkAboutReso 2020-135 - Rescinding requirement to retain easement for suplus prop at 5435 Mountain view (APN-116-220-038) RESOLUTION NO. 2020-135 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDDING RESCINDING THE REQUIREMENT TO RETAIN AN EASEMENT TO PROVIDE TURNAROUND LOCATION FOR COMMERCIAL VEHICLES FOR THE SURPLUS PROPERTY LOCATED AT 5435 MOUNTAIN VIEW (APN 116-220-038), AND AUTHORIZING THE CITY MANAGER, OR DESIGNEE, TO NEGOTIATE THE TERMS OF THE SALE AND EXECUTE ANY OTHER DOCUMENTS NECESSARY TO CONCLUDE THE SALE AND TO TRANFER TITLE TO THE BUYER, SUBJECT TO THE RETENTION OF ANY EASEMENT(S), IF REQUIRED, FOR PUBLIC SERVICE UTILITIES WHEREAS, the City of Redding owns property located at 5435 Mountain View (APN 116-220-038) (the Property), described in the attached location map; and WHEREAS, in February 1994, the California Department of Transportation (Caltrans) deeded the property to the City conditioned upon the property being used exclusively for public purposes for a 15-year period, which lapsed in 2009; and WHEREAS, each City department was consulted, and in 2014, the only current or future municipal use identified was the retention of an easement to serve as a turnaround location for commercial vehicles; and WHEREAS, in 2014, by Resolution 2014-072, the City Council declared the property surplus, subject to the retention of an easement for a turnaround location for commercial vehicles; and WHEREAS, the City of Redding has determined that there is not a need to retain the property for public purposes nor for commercial truck turnaround; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF REDDING DOES HEREBY RESOLVE THAT: 1. The above recitals are true, correct, and are adopted herein as findings of fact. 2. The prior condition of retention of easement(s) for the purpose of commercial vehicle turnaround is hereby rescinded. J 3. The sale of the property is subject to the retention of easement(s) for public utility use. L/ 4. Sale of the Property by the City is categorically exempt from the requirements of the California Environmental Quality Act (CEQA) pursuant to Section 15312 of the CEQA Guidelines (Surplus Government Property Sales). r' r w 5.
