HomeMy WebLinkAboutReso 95-141 - Approving entering into contribution agreement no 02F632 between COR & State of Calif, Dept of Transportion, for Canyon Rd/State Hwy 273 Traffic signal improvements �� - ` � • RESOLUTION NO. 95- �7� A RESOLUTION �F THE CITY COUNCIL OF THE CITY OF REDDING APPROVING ENTERING INTO CONTRIBUTION AGREF�MENT NO. 02F632 BETWEEN THE CIT'Y OF REDDING AND THE STATE OF CALIFORNIA, DEPARTMENT OF TRANSPORTATION, FOR THE CANYON ROAD/STATE HIGHWAY ROUT$ 273 TRAFFIC SIGN.AL. IlIdPROVEMENTS. WHEREAS, the City of Redding (City) and the State of California, Department of Transportation (Caltrans), pursuant to Streets and Highways Code Section 130, are authorized to enter into contribution agreements for improvements to State highways within the City of Redding; and WHEREAS, Caltrans contemplates the construction of a bridge replacement at the Clear Creek Bridge (No. 06-08L1R), referred to as the "Project"; and WHEREAS, the Project requires the installation of a temporary traffic control signal and safety lighting at the intersection of Canyon Road with State Highway Route 273 for handling tra.ffic during construction of the Project; the bridge and signal work is the responsibility of the State and will be funded 100% by the State; and WHEREAS, this intersection is the entrance to Win River Bingo and access to both City and County residential communities; and WHEREAS, due to the benefits that long-term signalization would have to the City, the County, and the Win River operations, staff contacted Caltrans regarding constructing a permanent, rather than temporary, signal concurrent with the bridge construction; and wHEREAS, Caltrans indicated that it would cost $75,000 extra for a permanent installation; and if this difference were paid, Caltrans would modify their construction plans; and WHEREAS, staff inet with representatives of the County and the Win River organization regarding the Caltrans' proposal; and it was concluded that there were mutual benefits and that each agency should consider contributing $25,000 toward the permanent signal; and ��� WHEREAS, attached hereto and made a part hereof is Caltrans Contribution �� Agreement No, 02F632 with the City, setting forth the contributions and �� responsibilities of each party, including the City making a one-time contribution � of $25,000 toward the cost of the improvements; acting as the depository for the \ �� � ' . � � County and the Redding Rancheria Tribal Government; and reimbursing the State for the City's proportion of the maintenance costs of the traffic control signal and safety lighting; and WHEREAS, the agreement further provides that maintenance of the traffic control signal (owned by the State) will be performed in accordance with the freeway or conventional.highway maintenance agreements presently in effect with the City or as may be executed or moclified hereafter; NOW, THEREFORE, IT IS HEREBY RESOLVED that the City Council of the City of Redding approves entering into Contribution Agreement No. 02F632 and the funding required thereunder; that the Mayor is authorized to sign the agreement on behalf of the City; and the City Clerk is directed to attest the signature of the Mayor and impress the official seal of the City of Redding thereto. LEONARD [�IN E, City Attorney � __- ____ i - ' ' � � � � 02 SHA 273 11. 2/11. 8 , 02365-260931 In Shasta County in Redding at Clear Creek Bridge District Agreement No. 02F632 Page 1 of 4 CONTRIBUTION AGREEMENT THIS AGREEMENT, ENTERED INTO ON is between the STATE OF CALIFORNIA, acting by and through its Department of Transportation, referred to herein as "STATE" and CITY OF REDDING, a body politic and municipal corporation of the State of California, referred to herein as "CITY" RECITALS (1) STATE AND CITY, pursuant to Streets and Highway Code Section 130, are authorized to enter into a Contribution Agreement for improvements to State highways within CITY. (2) STATE contemplates the construction of bridge replacement at the Clear Creek Bridge (No. 06-08L/R) , referred to herein as "PROJECT" . (3) PROJECT requires installation of traffic control signal and safety lighting at the intersection of Canyon Road with State Highway Route 273 for traffic handling during construction of PROJECT. Said bridge and signal work is the responsibility of STATE and will be funded 100% by STATE. (4) Mutual benefits to CITY and STATE will be realized by the signal installation, referred to herein as IMPROVEMENTS, and CITY desires to make a financial contribution towards the costs of IMPROVEMENTS. (5) The parties hereto intend to def ine herein the terms and condition under which IMPROVEMENTS are to be constructed, financed, and maintained. ; � • • District 2 , Agreement No. 02F632 Page 2 of 4 SECTION I STATE AGREES• (1) To administer the construction contract for PROJECT and IMPROVEMENTS and bear the actual entire cost thereof. (2) To maintain the entire traffic control signal and safety lighting as installed and pay an amount equal to 670 of the total maintenance cost, including electrical energy cost. (3) To operate the traffic control signal as installed and pay 100% of the operation cost. SECTION II CITY AGREES• (1) To contribute the amount of $25, 000 towards the costs of IMPROVEMENTS. (2) To Enter into an agreement with Shasta County and the Redding Rancheria Tribal Government to act as depositary of fund which Shasta County and the Redding Tribal Government also desire to contribute an additional amount of $25, 000 each toward IMPROVEMENTS. (3) CITY makes good faith effort to participate in the costs of IMPROVEMENTS and will deposit with STATE as soon as funds are allocated by CITY. CITY will transfer to STATE funds received from Shasta County and the Redding Rancheria Tribal Government when these funds are deposited with CITY. (4) To reimburse STATE for CITY's proportion share of the cost of maintenance of said traffic control signal and safety lighting, such share to be an amount equal to 33% of the total maintenance cost, including electrical energy cost. , , : � � District 2 Agreement No. 02F632 Page 3 of 4 5ECTION III IT IS MUTUALLY AGREED: (1) All obligations of STATE under the terms of this Agreement are subject to the appropriation of resouxces by the Legislature and the allocation of resources by the', California Transportation Commission. All obligations of CITY are subject to appropriation of funds by the CITY Council. (2) Upon completion of all work under this Agreement, ownership and title to all materials, equipment, and appurtenances installed will automatically be vested in STATE and no further agreement will be necessary to transfer ownership to STATE. (3) CITY will notify STATE as soon as funds are on deposit with CITY and STATE will submit to CITY a statement within 30 days after said notification. CITY will transfer funds to STATE within 30 days upon receipt of said statement. (4) Maintenance of the traffic control signal will be performed in accordance with the freeway or conventional hiqhway maintenance agreements presently in effect with CITY or as may be executed or modified hereinafter. 5) Neither STATE nor any officer or employee thereof is responsible for any damage or liability occurring by reason of anything done or omitted to be done by CITY under or in connection with any work, authority or jurisdiction delegated to CITY under this Agreement. It is understood and agreed that, pursuant to Government Code Section 895. 4, CITY shall fully defend, indemnify and save harmless the State of California, all officers and employees from all claims, suits or actions of every name, kind and description brought for or on account of injury (as defined in Government Code Section 810. 8) occurring by reason of anything done or omitted to be done by CITY under or in connection with any work, authority or jurisdiction delegated to CITY under this Agreement. I ` � � District 2 ; Agreement No. 02F632 , Page 4 of 4 : (6) This Agreement shall terminate upon receipt by STATE of funds specified in Section II, Article (1) and (2) of this Agreement, or on June 30, 2000, whichever is earlier in time; however, the ownership, operation, maintenance and liability clauses shall remain in effect until terminated or modified, in writing, by mutual agreement. The termination date specified above may be extended by amendment to this Agreement upon mutual agreement of the parties hereto.
