A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDDING
FINDING THAT PUBLIC INTEREST AND NECESSITY REQUIRE THE
ACQUISITION OF A 15' PERMANENT OVERFIEAD ELECTRIC UTILITY
EASII�IENT CONTAINING 0.11 ACRE �R 4,792 ( ±) SQUARE FEET FOR A
TRANSMISSION LINE FOR NEC$SSARY PUBLIG IMPROVFMF�ITS, NAMLLY
THE CONSTRUCTIUN AND MAIT�I'TF�iiANCE OF THE. SOUTH AIRP'ORT
115/12RV TR.ANSMISSION LINE PROJECT.
THE PROPERTY IS OWN� BY RICHARD A. FALR AND CHRISTELLE B.
FALK, AND IS GFNFRAT.LY LOCATED 150 FEET SOUTii OF THE SOUTI�
SIDE OF SYLVIA LANS AND 2,500 FEET WEST OF RISLING ROAD, IN
SHASTA COUNTY, CALIFORNIA (APN 054-290-35) .
WHEREAS, the South Airport 115/12kV Transmission Line Project
(Project) is essential to allow the City of Redding Electric Utility to
continue to provide reliable electric service ta the south/southeast
Redding area, and to support area development; and
WHEREAS, the Planning Commission, on January 25, 1994, certified
Final Environmental Impact Report 6-92 (FEIR-6-92) , and made its
recommendation to the City Council for the location of the substation
and the preferred route for the Project; and
WHEREAS, the City Council, on March 2, 1994, adogted Resolution
No. 94-43 finding that FEIR-6-92 adequately addressed the environmental
impacts of the Project, and that changes or alterations had been
required in or incorporated into the Project which mitigate or avoid
the significant enviranmental effects thereof as identified in FEIR-6-
92; Council also adopted a Mitigation Monitoring and Reporting Program,
and Preferred Raute A and Subsite A of FEIR 6-92 as the route of the
Project; and
WHEREAS, the purpose of the proposed transmission line is to
provide the following electric utility improvements: _ \
(a) 12kV distribution ta new loads south of the Airport �v
Substation/Sylvia Lane area;
4b) City electric service to the recently-annexed Stillwater �
Treatment Plant and to other areas currently located in the �
City and south of Meadowview Drive that are currently served 1 '
by Pacific Gas and Electric; �
(c) Transmission service to large industrial customers in the �'
Airport area; �

(d) Backup to existing City electrical facilities in the event of
planned maintenance or outages of other facilities;
( e) Transmission to a future substation on the Stillwater
Treatment Plant;
(f) A vital link in the preferred expansion plan of the City' s
115/12kV transmission system. It is the first segment of a
future 115/12kV loop along the City' s east "Sphere of
Influence" line, or east side of the Municipal Rirport; and
the first segment of a future SW 115/12kV loop to a future
115/12kV substation on the Clear Creek Treatment Plant
property; and •
(g) Reduced system losses and improved system reliability;
NOW, THF.RF�R1;, the City Council of the City of Redding FINDS,
DETERMINES and RESOLVES as followsr
1 . The acquisition of a 15' permanent overhead electric utility
easement over the hereinafter-described real property is necessary
fQr the extension of public improvements by the City of Redding
for the South Airport 115/12kV Transmission Line Project
(Project) .
2. Government Code Section 37350.5 and Code of Civil Procedure
Section 1240 .125 authorize the City to acquire the neces�ary real
property interests for said public improvements by eminent domain.
3 . Public interest and necessity require the Project.
4. The Project is planned or located in the rnanner that will be most
compatible with the greatest publie good and the least private
injury.
5. It is n�cessary to acquire the following real property interests
for the construction and maintenance of the Project, and that the
taking of said interests is necessary inasmuch as the praperty is
located along the preferred line route �hosen pursuant to the
exhaustive routing studies which were part of FEIR-6-92:

containing 0.11 acre or 4,792 ( ±) square feet for a.
transm.ission line as described in $xhibit "A" and shown
crosshatched on ExhiYait "B" attached hereto and made a
part hereof.
The property is generally located 150 feet south of the
south side of Sylvia Lane and 2,500 feet west of Kisling
Road, in Shasta County, California (APN 054-290-35) .

Said real property interests are owned by Richard A.
Falk and Christelle B. Falk as Joint Tenants .
6 . A written offer which the City believes to be just compensation
for the real property has been made to the owners of record
pursuant to Section 7267 .2 of the Government Code, and notice of
the intent to adopt this Resolution has been given in accordance
with Code of Civil Procedure Section 1245 . 235 .
BE IT FURTHER RESOLVED that the City Attorney of the City of
Redding is authorized, empowered, and directed, in the name of and on
behalf of the City of Redding, to commence an action or actions in
eminent domain in the Superior Court of the State of California, County
of Shasta, to acquire the above-mentioned real property interests, and
to incur all obligations and expenses necessary therefor.
BE IT FURTHER RESOLVED that the City Clerk of the City of Redding
is directed to cause a certified copy of this Resolution to be recorded
in the office of the Shasta County Recorder/Assessor.
I HEREBY CERTIFY that the foregoing Resolution was int.roduced,
read, and adopted at the July 18, 1995 , regular meeting of the City
Council of the City of Redding by the following four-fifths vote :
