WHEREAS, the City of Redding entered into Power Sales Contract DE-MS65- 83WP59008 with the Western Area Power Administration (Western) dated January 16, 1984; and WHEREAS, Western has proposed changing the methodology used to calculate Redding's energy entitlement to allow the energy accounting to comport with the federal fiscal year; and WHEREAS, Council has been advised that changing the calculations from a calendar year to a federal fiscal year will not affect the amount of energy Redding is entitled to, except during the transition period of August 1 through September 30, 1995; and the proposed revision is structured so that the transition will not create additional costs for Redding, and will provide a potential to lower power costs during the transition period by a few thousand dollars; and WHEREAS, attached and made a part hereof is proposed Exhibit D (Calculation of Monthly Energy Entitlement), Revision 3 to Amendment 3 to Contract DE-MS65- 83WP59008, changing the time period used in the calculations which determine Redding's � energy entitlement; and i WHEREAS, the Electric Department has concluded that there are no downside risks �' . � associated with the proposed revision, and that approving the revision will help strengthen � the City's working relationship with Western; � `�U r • � • NOW, THEREFORE, IT IS HEREBY RESOLVED that the City Council of the City of Redding approves entering into Exhibit D (Calculation of Monthly Energy Entitlement), Revision 3 to Amendment 3 to Contract DE-MS65-83WP59008; and authorizes the Electric Utility Director or his designee to execute the revision on behalf of the City, and the City Clerk to attest his signature and impress the official seal of the City. This Exhibit D, Revision 3 to be effective under and as a part of Amendment No. 3 (Amendment) to Contract No. DE-MS65-83WP59008 (Contract), shall become effective on the first day of , 1995; shall terminate and supersede the previous Exhibit D, dated November 14, 1994; and, shall remain in effect until either superseded by another Exhibit D or upon termination of the Amendment or Contract. 2. The attached table shows Redding's monthly energy entitlement under this Amendment and the derivation thereof. The Parties agree that the Annual Scheduled Western Energy and the Annual Energy Entitlement defined in Sections 5.1 and 5.2 of the Amendment will henceforth be computed on a Federal fiscal year(October 1 st through September 30th) basis, rather than on a ca(endar year basis, as is provided for in the Contract. All obligations in Section 7 of the Amendment related to the Annual Scheduled Western Energy and Annual Energy Entitlement shall similarly be computed on a Federal fiscal year basis.
