A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDDING
SUIVIMARILY VACATING ONLY THAT PORTION OF THE PUBLIC UTII,ITY
EASEMENT LOCATED ON LOT 33, MANZAlVITA VILLAS SUBDIVISION,
CONTAINING AN OBSOLETE 24-INCH STEEL WATERLINE.
WHEREAS, a variable-width public utility easement over Lot 33 of the Manzanita Villas
Subdivision was dedicated to the City of Redding with the recording of the Map of the Manzanita
Villas Subdivision in Book 16 of Maps at page 14, Shasta County Records (Easement); and
WHEREAS, the Public Works Department has advised the City Council that the 24-inch steel
waterline located within said Easement is obsolete and no longer used, as a result of the expansion of
the Foothill Treatment Plant in the late 1980's; and
WHEREAS, it is proposed that the portion of the Easement containing the 24-inch steel
pipeline, which is described in Exhibit A and shown crosshatched as the "Area to be Abandoned" on
Exhibit B attached hereto, be abandoned by summary vacation; and
WHEREAS, Exhibit B also shows the "Area to Remain Easement" for storm-drain purposes; �
and
WHEREAS, the City Council has been further advised that all local utility companies concur �(�
with the proposed abandonment of that portion of the Easement containing the 24-inch steel waterline, i !
shown as the "Area to be Abandoned"; \
NOW, THEREFORE, the City Council of the City of Redding hereby FINDS, �
DETERMINES, and RESOLVES as follows: �

1. The City Council elects to proceed in this matter under the provisions of the Public Streets,
Highways, and Service Easements Vacation Law as the same is set forth in Section 8330, et
seq., of the Streets and Highways Code of the State of California.
2. Only that portion of the public utility easement described in Exhibit A and shown crosshatched
as the "Area to be Abandoned" on Exhibit B is no longer necessary and is hereby vacated; the
area shown as "Area to Remain Easement" is to be reserved for storm-drain purposes.
3. This summary vacation is based upon the following facts:
a) That portion of the Easement hereby vacated is obsolete and is no longer used by the
City's water division. With the expansion of the Foothill Treatment Plant in the late
1980's, the City is utilizing a larger waterline located within Foothill Boulevard.
b) With the exception of the obsolete 24-inch steel pipeline left in place, there are no
other public utility facilities within the area vacated.
4. The City Clerk is hereby directed to record a certified copy of this resolution of vacation,
attested by the Clerk under seal, in the office of the Shasta County Assessor/Recorder.
5. From and after the date this Resolution is recorded, only that portion of the Easement hereby
vacated shall no longer constitute a public utility easement.
I HEREBY CERTIFY that the foregoing Resolution was introduced, read, and adopted at a
regular meeting of the City Council on the l st. day of August , 1995, by the following vote:

16 of maps at Page 14, Shasta County Records lying Northerly of
the following described line:
Beginning at the Southwest corner of said Lot 33 ; thence,
N. 10°34'23"W. , 21. 16 feet to the True Point of Beginning: thence,
N.72°22'41"E. , 84. 04 feet thence, N. 58°36'59"E. , 96. 69 feet to
the Point of Termination on the Easterly line of said Lot 33 from
which the Southeast corner bears S. 17°37'19"E. , 44. 00 feet.
