Code §6103 � A.P.N. � RESOLUTION NO. 95-264 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDDING SU1�Il�IARILY VACATING A PORTION OF OLD ALTURAS ROAD. WHEREAS, the improved portion of road described in Exhibit A and shown crosshatched on Exhibit B attached hereto and made a part hereof (hereinafter referred to as the "Area of Abandonment") was acquired by the City of Redding by prescription based on a 1948 alignment as shown on a map recorded in Book 17 of Land Surveys at page 30, Shasta County Records; and WHEREAS, with the widening and realignment of Old Alturas Road, the Area of Abandonment is excess right-of-way no longer required for roadway purposes; and WHEREAS, the Public Works Department has advised the City Council that there are no in-place public utility facilities that are in use or would be affected by the vacation; NOW, THEREFORE, the City Council of the City of Redding \ hereby RESOLVES and ORDERS as follows : � l . The City Council elects to proceed in this matter under C,( the provisions of the Public Streets, Highways, and 9� Service Easements Vacation Law as set forth in Section � 8330, et seq. , of the Streets and Highways Code of the � State of California. • • 2 . There are no in-place public utility facilities within the Area of Abandonment that are in use or would be affected by the vacation. 3 . With the widening and realignment of Old Alturas Road, the Area of Abandonment has been superseded by relocation and is no longer necessary. Upon acceptance of the Area of Abandonment by the adjacent property owners, the area described in Exhibit A and depicted in Exhibit B is hereby vacated. 4 . When the Area of Abandonment has been accepted by the adjacent property owners, to be verified by the City Attorney, the City Clerk is hereby directed to cause a certified copy of this resolution of vacation, attested by the Clerk under seal, to be recorded in the office of the Shasta County Assessor/Recorder. 5 . From and after the date this resolution is recorded, the Area of Abandonment hereby vacated no longer constitutes an improved roadway. I HEREBY CERTIFY that the foregoing Resolution was introduced, read, and adopted at a regular meeting of the City Council on the2lst day of Nov. , 1995, by the following vote: AYES: COUNCZL MEMBERS: P .
