HomeMy WebLinkAboutReso 95-274 - Approving entering into agreement between the City & Pacificorp: A short term power sales agreement % ^ ' � • RESOLUTION NO. 95-��'I A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDDING APPROVING ENTERING INTO THE FOLLOWING AGREEMENTS BETWEEN THE CITY AND PACIFICORP (PROPOSED AGREEMENTS): A SHORT- TERM POWER SALES AGREEMENT, A LONG-TERM POWER PURCHASE AGREEMENT, A LONG-TERM POWER SALES AND EXCHANGE AGREEMENT, AND A SERVICE AGREEMENT UNDER FEDERAL ENERGY REGULATORY COMMISSION (FERC) TARIFF PPL-3. WHEREAS, the City of Redding currently has two power contracts with PacifiCorp: (1) a Long-Term Power Sales Agreement executed in October 1993 by which Redding purchases 50 MW of capacity and associated energy from PacifiCorp; and (2) a Power Exchange Agreement executed in April 1995 by which Redding provides power to PacifiCorp from San Juan in exchange for a billing credit under the Long-Term Power Sales Agreement; and WHEREAS, in an effort to reduce electricity costs, the Electric Department approached PacifiCorp a few months ago with suggestions for enhancing the contractual arrangements between the City and PacifiCorp; and WHEREAS, subsequent negotiations have resulted in an arrangement projected to provide significant benefits to the City's electric ratepayers, as set forth in the accompanying Report to City Council; and WHEREAS, the Proposed Agreements will work in conjunction with the two existing Redding/PacifiCorp agreements, as well as an existing agreement with the Western Area Power Administration; and WHEREAS, the City Council has determined that it is desirable and furthers the public purpose to enter into the Proposed Agreements with PacifiCorp; NOW, THEREFORE, IT IS HEREBY RESOLVED that the City Council approves entering � into the following agreements between the City of Redding and PacifiCorp: ► Short-Term Power Sales Agreement, � ► Long-Term Power Purchase Agreement, � ► Long-Term Power Sales and Exchange Agreement, and � ► Service Agreement under FERC Tariff PPL-3, � in substantially the form on file with the City Clerk and incorporated by reference as if fully set forth � herein. • . .: � • BE IT FURTHER RESOLVED that the Mayor is authorized to sign said agreements on behalf of the City of Redding, and the City Clerk is directed to attest, seal and deliver the same, with such changes therein as shall be approved by the City Attorney and the Mayor executing the same, with such execution to constitute conclusive evidence of such officers' approval and the City's approval of any changes or revisions therein from the form of agreements on file with the City Clerk.
