A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
REDDING SUMMARILY VACATING A PORTION OF A 10' WIDE
PERMANENT EASEMENT FOR PUBLIC SERVICE PURPOSES
DEEDED BY EVERGREEN PARTNERSHIP TO THE CITY ON
MARCH 6, 1992, AND RECORDED IN BOOK 2870 OF OFFICIAL
RECORDS AT PAGE 291, SHASTA COUNTY RECORDS.
WHEREAS, a 10' wide permanent easement for public service purposes was deeded
to the City by Evergreen Partnership on March 6, 1992, and recorded June 5, 1992, in Book
2870 of Official Records at page 291, Shasta County Records ("Easement"), as more
particularly shown on Exhibit "B" attached hereto and made a part hereof; and
WHEREAS, the joint utility pole and guy located in the westerly portion of the
Easement has been relocated to the easterly portion to facilitate new building plans for the
property; and
WHEREAS, the property owner has requested the abandonment of the westerly
portion of the Easement, as more particularly described in Exhibit "A" attached hereto and
made a part hereof and shown crosshatched in Exhibit "B"; and
WHEREAS, the Public Works Department has advised the City Council that, with
the relocation of the joint utility pole and guy to the easterly portion of the Easement, there
are no in-place public utility facilities that are in use or would be affected by vacating the
westerly portion of the Easement;
NOW, THEREFORE, the City Council RESOLVES and ORDERS as follows:

1. The City Council elects to proceed in this matter under the provisions of the Public
Streets, Highways and Service Easements Vacation Law as set forth in Section 8330,
et seq., of the Streets and Highways Code of the State of California.
2. With moving the joint utility pole and guy to the easterly portion of the Easement, the
westerly portion of the Easement has been superseded by relocation and there are no
other public facilities located therein.
3. The City Council approves the request to summarily vacate the westerly portion of the
Easement, as more particularly described in Exhibit A and shown crosshatched in
Exhibit B.
4. The City Clerk is directed to cause a certified copy of this resolution of vacation,
attested by the Clerk under seal, to be recorded in the office of the Shasta County
Assessor/Recorder.
5. From and after the date this resolution is recorded, the westerly portion of the
Easement hereby vacated shall no longer constitute a power-line easement.
I HEREBY CERTIFY that the foregoing resolution was introduced, read and
adopted at a regular meeting of the City Council on the 5th day of March , 1996, by
the following vote:

PUBLIC SERVICE EASEMENT ABANDONMENT
All that certain real property situate in the City of Redding, County of Shasta, State of California,
described as follows:
All that certain property described in the Easement Deed executed by Evergreen Partnership to
the City of Redding dated March 6, 1992 and recorded June 5, 1992 in Book 2870 of Official
Records at page 291, Shasta County Records, and being a portion of that certain described 10
foot strip of land in Section 5, Township 31 North, Range 4 West, MDM, more particularly
described as being 5.00 feet on each side of the following described centerline:
COMNIENCING at a 5/8" pin with a 2 '/2" brass cap marked R.E. 5438, being the Southeast
corner of Parcel "D" as shown on that certain Parcel Map recorded in Book 7 of Parcel Maps at
page 56, Shasta County Records; thence along the East line of said Parcel "D", North 00°40'03"
East a distance of 265.20 feet to point on the center line of said aforementioned 10 foot strip of
land; thence along said centerline, North 89°19'S7" West a distance of 47.00 feet to the Point of
Beginning of this description; thence continuing North 89°19'S7" West a distance of 48.00 feet to
the point of termination of said 10 foot strip of land. Containing .O 1 Acres (480 Square Feet),
more or less.
