A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
REDDING APPROVING ENTERING INTO AN AUTHORIZATION
FOR PROFESSIONAL SERVICES CONTRACT WITH MTI
TESTING LABORATORY INC. FOR MATERIALS TESTING
AND/OR INSPECTION SERVICES RELATED TO THE LAKE
REDDING BRIDGE PROJECT, IN AN AMOUNT NOT TO
EXCEED $39,263.
WHEREAS, on February 16, 1996, the Department of Public Works circulated a
Request for Proposal (RFP) to provide materials-testing services during the construction of the
Lake Redding Bridge Project; and
WHEREAS, the RFP asked for hourly rates for each aspect of the proposal, and
stipulated that the selection of a consultant would be by demonstrated professional competence
and experience only and not on price; and
WHEREAS, proposals were submitted by three local firms: MTI Testing Laboratory
Inc., Brown and Mills, and Kleinfelder; and
WHEREAS, MTI Testing Laboratory, Inc. (MTI) was judged to be the most qualified
firm to provide the materials testing, based on past experience, and staff is requesting approval
of a contract with MTI not to exceed $39,263; and �,

WHEREAS, funds for the Project were approved by the City Council on April 16, �

NOW, THEREFORE, IT IS RESOLVED BY THE CITY COUNCIL OF THE `�
CITY OF REDDING THAT:
1. The foregoing recitals are true and correct.

2. The City Council approves entering into the attached Authorization for
Professional Services contract with MTI Testing Laboratory Inc. in an amount
not to exceed $39,263.
3. The Mayor is authorized to sign said contract on behalf of the City; and the City
Clerk is directed to attest the signature of the Mayor and to impress the official
seal of the City of Redding thereto.
I HEREBY CERTIFY that the foregoing resolution was introduced, read and adopted
at a regular meeting of the City Council on the 4 th day of June , 1996, by the following

' PROVISIONS
l. Authorization To Proceed
Signing this form shall be construed as authorization by client for MTI to
proceed with the work, unless otherwise provided for in the authorization.
2. Direct Expenses
MTI �s direct expenses shall be those costs incurred on or directly for the
client' s project, including but not limited to necessary transportation costs
including mileage at MTI ' s current rate if its automobiles are used, meals ,
lodging and telephone charges. Expenses shall be on the basis of actual
charges furnishecl by commercial sources.
3. Outside Services
When technical or professional services are furnished by an outside source,
when approved by client, an additional 20o shall be added to the cost of these
services for MTI ' s administrative costs.
4. Professional Standards
MTI shall be responsible, to the level of competency presently maintained
by other practicing laboratories in the same type of work in the client' s
community, for the technical soundness and accuracy of all reports and other
work and materials furnished under this authorization. MTI makes no other
warranty, express or implied.
5. Legal Expenses
In the event legal action is brought by client or MTI against the other to
enforce any of the obligations hereunder or arising out of any dispute con-
cerning the terms and conditions hereby created, the losing p arty shall p ay
the prevailing p arty such reasonable amounts for fees, costs and expenses as
m ay be set by the court. Any action brought to enforce or interpret the provisions
of the contract shall be brought in Shasta County, California.
6. Samples
Al1 samples will be disposed of, or destroyed upon completion of testing
unless the client advises MTI otherwise. Upon request, the samples will be
delivered to client, charges collect, or MTI will store them for an agreed
charge.
7. Field Work
The presence of MTI field personnel will be for the purpose of providing
observation and field testing. Our work does not include supervision or
direction of the actual work of the contractor, his employees or agents.
The contractor for this project should be so advised. The contractor should
also be informed that neither the presence of MTI field personnel nor the
observation and testing by MTI shall excuse him in any way for defects dis-
coverecl in his work. It is understood that MTI will not be responsible for
job or site safety. Job and site safety will be the sole responsibility of
the client or contractor.
8. P ayment of Compensation
Invoices for our services will be submitted at our option, but not more than
twice a month. Invoices are due and p ayable upon receipt. If payment by
client o� any amount due MTI is not made within 30 days of invoice date, a

NOTE: All field labor charges shall be portal to portal.
The consultant shall include all transportation costs of every kind in the price
submitted for the various items of work provided and no additional or separate
compensation shall be provided herein.
The TOTAL CONTRACT PRICE FOR SERVICES provided assumes City of Redding
personnel will provide visual inspection of concrete and earthwork placement, pile
driving and concrete prestressing and no additional charges are to be included for
this work.
Insert a dollar value for each blank provided or Proposal will be deemed incomplete
and not evaluated for consideration.

GENERAL INFORMATION
1 . Listed herein are typical prices for observation and field
and laboratory services most frequently performed by MTI . Prices
for other services not listed will be given on request, as well as
quotations for programs involving volume work or special testing.
2 . All sampling and testing is conducted in accordance with the
standards as set forth by the American Society of Testing and
Materials, American Association of State Highway and Transportation
Officials or other agencies as required by project specifications.
3 . All work is supervised or performed by Certified Engineering
Technicians .
4 . Invoices will be issued bi-weekly or upon completion of a
project, whichever is sooner. Any unpaid balance, after 30 days of
the invoice date, shall incur a 1 .5% monthly finance charge ( 18�
annually)
5 . All samples will be discarded 30 days after being received
unless prior arrangements are made.
6 . Engineering consultation or services requiring a registered
engineer' s signature will be by quote only.
7 . Prices are subject to change and/or negotiation.
