"Scparalc Pagc" pursuant to Govcrnmcnt Codc §273G1.G ��Z�-`��42����E�94��� � � � � � RESOLUTION NO. 96- l0`J LANDSCAPE MAINTENANCE DISTRICT "C" A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDDING ORDERING THE DETAC�IlVIENT OF PHASE 3 OF THE FOREST HOMES ESTATES SUBDIVISION (AREA 7); CONFIRMING THE ASSESSMENT DIAGRAM; AND ORDERING THE LEVY OF THE ANNUAL ASSESSMENTS FOR FISCAL YEAR 1996/97 PURSUANT TO THE LANDSCAPING A.ND LIGHTING ACT OF 1972. WHEREAS, on April 2, 1996, the City Council approved the Report of the Engineer as filed relating to Landscape Maintenance District "C" (District), and gave notice of the time and place of the May 21, 1996, public hearing regarding the levy and collection of assessments for fiscal year 1996/97; and WHEREAS, the City Council also gave notice of its intention to detach Phase 3 of the Forest Homes Estates Subdivision (Area 7); and WHEREAS, a diagram of the area encompassed by the District (excluding Area 7), individual maps, and a summary are attached hereto and made a part hereof; and WHEREAS, the public hearing, duly and properly noticed, commenced at the City Council Chambers, 1313 California Street, Redding, California, on May 21, 1996, and was concluded prior to the adoption of this resolution; and WHEREAS, at the May 21 public hearing, the City Council gave every interested person an opportunity to object to the proposed annexation of additional territory and the assessment; and WHEREAS, all legal prerequisites to the adoption of this resolution have occurred (including a public meeting held May 7, 1996, although not required pursuant to Government Code section 54954.6) ; NOW, THEREFORE, THE CITY COUNCIL FINDS, RESOLVES, DETERMINES AND � ORDERS AS FOLLOWS: v � 1. The matters set forth above are true and correct. � �J , . .. . . :: �����3426���E �95 _ . � . �� i � 2. The City Council has considered all oral statements and written protests or communications made or filed by interested persons at the public meeting of May 7, 1996, and the public hearing of May 21, 1996, and expressly overrules any and all protests filed objecting to the proposed assessments to be levied in the District. 3. The assessment diagram contained in the Engineer's Report is adopted and confirmed. 4. The City Council finds that the Engineer has fairly and properly apportioned the cost of the improvements to each lot/remaining parcel of land in the District (excluding Area 7) in proportion to the estimated benefits to be received by each lot/remaining parcel from the improvements. 5. The assessment of$7.46 for each lot and remaining parcel located within the District for fiscal year 1996/97 is adopted and confirmed, except that an assessment shall not be levied on property owned by a federal or state governmental agency or another local agency. 6. The City Clerk shall forthwith transfer to the Auditor and the Assessor/Recorder of Shasta County a certified copy of this resolution and a certified copy of the assessment diagram contained in the Engineer's Report.
