A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
REDDING DECLARING ITS INTENTION TO DISESTABLISH THE
PARKING AND BUSINESS IMPROVEMENT AREA ESTABLISHED
IN SECTION 6.18150 OF THE REDDING MUNICIPAL CODE.
WHEREAS, in 1976 the City Council formed a Parking and Business Improvement District for
the Downtown Mall under the Parking and Business Improvement Area Law of 1965 as set forth in Section
36000 et seq. of the Streets and Highways Code of the State of California; and
WHEREAS, the purpose of the District is to provide free public parking and removal of parking
meters, promote public events that take place within the area, furnish music in any public place in the
designated area, and to generally promote retail trade activities in the area; and
WHEREAS, the Parking and Business Improvement District covers an area generally bordered by
California Street to the west, Placer Street to the south, the alley between Market and Pine Streets to the
east, and Tehama Street to the north; its present assets amount to approximately $6,000; and
WHEREAS, the City Council has received a written petition from the owners of real property in
the area who pay 50 percent or more of the assessments levied, asking that said area be dissolved; and
WHEREAS, Streets and Highways Code Section 36550 et seq. and Redding Municipal Code
Chapter 6.18 set forth the procedures by which the City Council may disestablish an area by adopting an
ordinance after holding a public hearing on the disestablishment; and
WHEREAS, the City Council elects to proceed in this matter under the provisions of said Code
sections, with the provision that this resolution shall be deemed a resolution of intention;
NOW, THEREFORE, IT IS RESOLVED by the City Council as follows: �
1. All of the foregoing recitals are true and correct. �()

2. The City Council—having received a written petition from the owners of real property in the area �
who pay 50 percent or more of the assessments levied in the Parking and Business Improvement �
District for the Downtown Mall asking that the area contained in the district be dissolved—declares (�
its intention to consider the disestablishment of the area encompassed by the Parking and Business �

Improvement District for the Downtown Mall, established pursuant to the provisions of the Parking
and Business Area Improvement Law of 1965. Said area is more particularly described in Redding
Municipal Code Section 6.18.160, a copy of which is attached hereto and made a part hereof.
3. All persons interested in or objecting to the proposed disestablishment will be heard on Tuesday,
September 3, 1996, at the hour of 7:00 p.m. or as soon thereafter as the matter may be heard, in
the City Council Chambers located at 1313 California Street, Redding, California.
4. Upon the disestablishment of the area, if approved by City Council, any remaining revenues derived
from the levy of assessments, or any revenues derived from the sale of assets acquired with the
revenues, shall be refunded to the owners of the businesses then located and operating within the
area in which assessments were levied by applying the same method and basis that was used to
calculate the assessments levied in the fiscal year in which the area is disestablished.
5. The City Clerk is instructed to give notice of this hearing as follows:
a) One publication of this resolution of intention in a newspaper published and circulated in
the City on or before August 18, 1996, pursuant to Redding Municipal Code Section
6.18.040; and
b) Mailing of a complete copy of the resolution of intention, postage prepaid, in a sealed
envelope, to each business in the area proposed to be disestablished, as shown upon the
active business license rolls on file in the office of the City Clerk. The mailing shall be
within seven days of the City Council adopting this resolution of intention, or on or before
August 13, 1996, pursuant to Streets and Highways Code Section 36523(b).
I HEREBY CERTIFY that the foregoing resolution was introduced, read and adopted at a regular
meeting of the City Council on the 6th day of August, 1996, by the following vote:
