RESOLUTION NO. 96-�/ A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDDING ORDERING THE VACATION OF THAT PORTION OF THE DEL MONTE STREET RIGHT-OF-WAY LYING ADJACENT TO PROPERTY LOCATED AT 2185 CHURN CREEK ROAD (A-2-96). WHEREAS, proceedings have been duly conducted and held in accordance with the provisions of the Public Streets, Highways, and Service Easements Vacation Law, Streets and Highways Code Section 8300, et seq.; and WHEREAS, the City Council finds and determines that the portion of the Del Monte Street right-of-way lying adjacent to property located at 2185 Churn Creek Road is not necessary for present or prospective right-of-way purposes, SUBJECT TO the conditions hereinafter set forth; NOW, THEREFORE, the City Council of the City of Redding FINDS, RESOLVES AND ORDERS as follows: 1. The Council makes the following findings in connection herewith: (a) The project is compatible with the Redding General Plan; (b) The project will not significantly alter the existing land form; (c) The project is compatible with the surrounding land use; and (d) The project is compatible with the Redding Municipal Code. 2. That portion of the Del Monte Street right-of-way adjacent to property located at 2185 Churn Creek Road, in the City of Redding, County of Shasta, State of California, as more particularly described in Exhibit A attached hereto and made a part hereof and shown as the "Area of Abandonment" in Exhibit B attached hereto and made a part �'� hereof, is vacated as a street right-of-way, SUBJECT TO the condition that this abandonment shall not become effective nor shall this resolution be recorded unless and �� until the City of Redding prepares and approves a final metes and bounds description of �'; the vacated portion of Del Monte Street to be attached hereto in replacement of Exhibit �. "A" and the City of Redding City Council accepts the Option 2 Traffic Pattern � Improvements pursuant to the Owners Participation Agreement between the City of � Redding, the Redding Redevelopment Agency, and the owners of five adjacent properties, approved by the City Council on May 21, 1996 ("Owners Participation ; �::: ... .. , .: .. - ��-�� �35��PA�E6z0 . , •3���PA�E323 , � � • • Agreement"), and SUBJECT TO: (a) The terms and conditions of the Owners Participation Agreement; and (b) A permanent easement over the entire area of abandonment. The purpose of the easement shall be to erect, construct, reconstruct, repair, replace, remove, maintain and use for public service purposes any and all pipes, pipelines, wires, cables, including fiber optics, appliances and fixtures, over, along, upon, under and across the parcel of real property described in Exhibit "A" and shall include all rights to review and control the planting, maintaining, trimming or removing of any trees or other plants within said easement. 3. When the above conditions have been met, and pursuant to the Schedule of Performance set forth in the Owners Participation Agreement, the City Clerk is directed to record a certified copy of this resolution, attested by the Clerk under seal, in the office of the Shasta County Assessor/Recorder. Thence easterly along said centerline S 89° 09' 50" E, 35.00 to the . P.O.B.
