HomeMy WebLinkAboutMinutes - City Council - 2020-09-01 - Regular 264 Redding City Council, Regular Meeting Civic Center Council Chambers 777 Cypress Avenue Redding, CA 96001 September 1, 2020, 6:00 PM Due to the increase in the spread of Covid-19 and the latest directives from the Governor and the California Department of Public Health, the Mayor modified access to the City Council meeting to enable members of the public to make public comments with the following requirements: (a) entry to the Council Chambers was limited to members of the public wishing to address the Council on any agenda item; (b) people who wished to speak to the City Council checked-in with City staff at the Community Room door beginning at 5:45 p.m.; (c) speakers waited outside the building until time for the Council to hear the item. (d) City staff assembled the speakers and admitted up to four people into the Council Chambers at any one time. If more than four people wished to address an item, they were admitted following the comments from the first four speakers; (e) all members of the public were asked to wear a face mask, however, they could remove the mask while speaking; (f) speakers were given up to three (3)minutes to address the Council; and (g) after speaking, the individual left the building following the directional arrows and exited through the main chamber doors. The meeting was called to order by Mayor Adam McElvain with the following Council Members present: Michael Dacquisto, Erin Resner, Kristen Schreder, and Julie Winter. Also present were: City Manager Barry Tippin, City Attorney Barry DeWalt, City Clerk Pamela Mize, and Executive Assistant Anette Cates. PUBLIC COMMENT Council Member Winter remembered Rod Lindsey, former Mayor of Shasta Lake City, Executive Director to Local Indians for Education, and a well-known leader in Shasta County, that passed away last week. The City Council received a public comment online from Pete Marsh, inviting the Redding City Council, staff, and citizens to attend a fall course through Shasta College regarding "Global Warming - Causes, Effects & Solutions", incorporated herein by reference. William Gilbert opined that the City of Redding treated him and his wife unfairly regarding a code enforcement issue. CONSENT CALENDAR The following matters were considered inclusively under the Consent Calendar and each Report to the City Council (staff report) is incorporated herein by reference: 4(a). Approve Minutes: Special Meeting - Closed Session of August 18, 2020; and Regular Meeting of August 18, 2020. 4(b). Accept Payroll Register No. 3 and Accounts Payable Register No. 3. (1) Payroll Register No. 3 for the period of July 25, 2020 through August 8, 2020, in the amount of $3,233,293.37 for electronic deposit transaction numbers 516230 through 517213, inclusive, and check numbers 606360 through 606374, inclusive; (2) Accounts Payable Register No. 3 for period of August 1, 2020, through August 14, 2020, for a total of $4,019,789.92 for check numbers 156670 through 156972, inclusive, ACH Transfer numbers 16259 through 16280, inclusive, Wire Transfer numbers 9976 through 10115, inclusive; SUMMARY TOTAL: $7,253,083.29. 4(c). Accept the Treasurer's Report for the month of July 2020. 4(d). Accept the Proof of Cash reconciliation and ACR133 report for the month of July 2020. 09/01/2020 265 4.1(a). Accept report and make a determination by a four-fifths (4/5ths) affirmative vote that conditions of local emergency continue to exist within the City of Redding, under Public Contract Code section 22050(c)(1) related to the Coronavirus (COVID-19). 4.1(b). Approve Exclusive Listing Reinstatement Agreement—Sale Transaction with Redding Realty, Inc., for exclusive rights to sell real property owned by the City of Redding; and authorize the City Manager, or designee, to execute the agreement and any future amendments to the agreement. The Vote: AYES: Council Members - Resner, Schreder, Winter, and McElvain NOES: Council Members - Dacquisto ABSTAIN: Council Members -None ABSENT: Council Members -None 4.5(b). Accept report on the development status of Renewable Energy Resources and authorize Redding Electric Utility staff to: (1) discontinue work on the 10 megawatt local solar project previously authorized the City Council: and (2) authorize staff to continue developing cost-effective solutions to meet state renewable energy requirements. 4.6(a). Adopt Resolution No. 2020-109, a resolution of the City Council of the City of Redding, approving the 53`d Amendment to City Budget Resolution No. 2019-050 appropriating $1,413,820 for design, engineering, permitting, and construction work for three obligated and one pending Federal Emergency Management Agency projects for repairs to trails and parks damaged by the 2017 flooding event. 4.6(b). Authorize the following actions relative to Request for Proposals Schedule No. 5136, Design and Engineering Services for the Caldwell Park Expansion Project: (1) award to Gates & Associates; (2) authorize the City Manager, or designee, to execute a Consulting and Professional Services Contract with Gates & Associates for an amount not to exceed $450,000; and (3) authorize the City Manager, or designee, to approve any amendments up to $45,000. 4.9(a). Authorize and affirm submission of an application for the U.S. Department of Justice 2020 Edward Byrne Memorial Justice Assistance Grant in the amount of$42,816 to purchase needed replacement equipment related to officer safety and software for the Redding Police Department's Field Training Officer Program tracking; and authorize the City Manager to sign the grant application's Certifications and Assurances signifying that the governing body was notified of the application and citizens were provided the opportunity to comment on the application. 4.11(a).Adopt Resolution No. 2020-110, a resolution of the City Council of the City of Redding, by not less than four-fifths (4/5ths) affirmative vote, ratifying the City Manager's award of an emergency construction contract to Eddie Axner Construction, Inc. for emergency repair of a water main south of Girvan Road at North State Recycling. 4.11(b).Authorize the purchase of a vacuum excavator using Sourcewell contract pricing, with a net delivered cost of $465,582.75 to be used for the maintenance of the City of Redding Wastewater Collection system. A MOTION WAS MADE by Council Member Winter,seconded by Council Member Resner, that the forgoing items on the Consent Calendar be accepted, acknowledged, adopted, approved, authorized, and/or rescinded as recommended with the exception of those item(s) voted on separately above. Appointment of the Fire Chief of the Redding Fire Department for the City of Redding. City Manager Tippin provided the Report to City Council (staff report), incorporated herein by reference. A MOTION WAS MADE by Council Member Schreder, seconded by Council Member Resner,to approve the appointment of Jerrod Vanlandingham as the Fire Chief of the Fire Department for the City of Redding. The Vote: Unanimous. 9.11(b).Ordinance and Resolution - approving Wastewater Utility administrative updates. Public Works Director Chuck Aukland provided an overview of the Report to City Council (staff report), incorporated herein by reference. A MOTION WAS MADE by Council Member Winter, seconded by Council Member Resner, to authorize the following related to the 2020 City of Redding Enforcement Response Plan(ERP)for the Wastewater Utility to ensure the Redding Municipal Code and ERP conforms to state and federal regulations and requirements: (1) offer Ordinance No. 2627, an ordinance of the City Council of the City of Redding, amending Redding Municipal Code Title 14 (Utilities), Chapter 14.16 (Sewer)for first reading by title only and waive the full reading, direct the City Attorney to prepare a summary ordinance, and authorize the City Clerk to publish the summary ordinance according to law; (2) adopt Resolution No. 2020-111, a resolution of the City Council of the City of Redding, rescinding Resolution No. 2010-062 and approving the revised 2020 ERP; and (3) accept the 2020 Local Limits Re-evaluation Report. City Attorney DeWalt summarized the Report to City Council (staff report), incorporated herein by reference. A MOTION WAS MADE by Council Member Resner,seconded by Council Member Schreder, to offer Ordinance No. 2628, an ordinance of the City Council of the City of Redding, amending Redding Municipal Code Title 6 (Business Taxes, Licenses and Regulations), Chapter 6.12 (Cannabis) by amending Section 6.12.360 (Cultivation for Commercial Sale — License Required) and Section 6.12.640 (Remedies and Public Nuisance) for first reading by title only and waive the full reading; direct the City Attorney to prepare a summary ordinance if needed, and authorize the City Clerk to publish the summary ordinance according to law.
