HomeMy WebLinkAboutReso 2020-115 - Authorizing Mayor to Award an Emergency Const contract to repair damaged Wastewater Pipes near the Churn Creek Lift Station RESOLUTION NO. 2020-115 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDDING AUTHORIZING THE MAYOR TO AWARD AN EMERGENCY CONSTRUCTION CONTRACT TO REPAIR D A M A G E D WASTEWATER PIPES NEAR THE CHURN CREEK LIFT STATION WHEREAS, Public Contract Code section 22050 and Redding Municipal Code 4.2 2.12 0(A) provide that, in the case of emergency, a public agency may repair or replace a public facility, take any directly related and immediate action required by that emergency, and procure the necessary equipment, services, and supplies for those purposes without giving notice for bids to let contracts; and WHEREAS, on or about September 4, 2020, staff was made aware that two 8-inch wastewater conveyance pipes south of the Churn Creek Lift Station located near State Route 44 and Goodwater Avenue failed, likely due to shifting and age, breaking apart and causing a release of wastewater into the adjacent Churn Creek; and WHEREAS, the wastewater pipes serve as bypass pipes to convey raw wastewater to the Clear Creek Wastewater Treatment Plant to be treated prior to discharge to the Sacramento River; and WHEREAS, a competitive solicitation for bids will delay the repairs needed to prevent further damage to the environment and to restore use of the bypass pipes during significant weather events or lift station inoperability; and WHEREAS, further failure of the wastewater system would threaten the health, safety and property of public and the environment nearby because of the potential release of raw wastewater into Churn Creek; and WHEREAS, there are no other viable options to mitigate or eliminate the threat to public health in which competitive bidding could be accommodated and that would contain or otherwise divert the wastewater from the failed pipes should the ability to utilize the Churn Creek Lift Station become comprised due to failure, inundation or necessary operations downstream; NOW, THEREFORE, BE IT RESOLVED THAT: 1. The City Council of the City of Redding finds that the recitals set forth above are true and correct and are hereby adopted as findings of fact. 2. The public interest and necessity require the immediate expenditure of public money to restore the wastewater conveyance system, protect the public health, safety and welfare, and prevent further damage to the area. 3. The City Council of the City of Redding t h e r e fo r e authorizes the City Manager to award an emergency construction contract to repair the wastewater system south of the Churn Creek Lift Station near the State Route 44 and Goodwater Avenue. 4. The action authorized herein shall be reviewed by the City Council at all regular meetings of the Council until such time as the City Council determines that the emergency is abated.
