A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDDING
FINDING THAT PUBLIC NECESSITY REQUIRES THE ACQUISITION OF
CERTAIN REAL PROPERTY INTERESTS FOR A TEMPORARY
CONSTRUCTION EASEMENT AND A PERMANENT SEWER
EASEMENT FOR NECESSARY PUBLIC IMPROVEMENTS, NAMELY A
SEWER LINE EXTENSION APPROVED FOR SUN OAKS RACQUET
CLUB (PROJECT).
THE PROPERTY IS OWNED ONE-THIItD BY DOUGLASS AND RAMONA
FRASER; ONE-THIRD BY BRUCE AND LOUISE FRASER; AND ONE-
THIRD BY MARGOT FRASER DEHOFF, AND IS LOCATED ON THE
EAST SIDE OF ARGYLE ROAD OPPOSITE INTERSECTION WITH
FOREST HILLS DRIVE; APN 110-220-08.
WHEREAS, On October 1, 1996, the City Council approved the use of the City's power
of eminent domain to acquire right-of-way for the extension of the Sun Oaks Racquet Club sewer
line in accordance with Administrative Use Permit 19-94, as amended, issued to the Sun Oaks
Racquet Club (developer) and Environmental Determination 3-95; and
WHEREAS, in order to meet the conditions of the administrative use permit, as amended,
and the environmental determination, the developer must acquire a (+�-) temporary construction
easement of 0.44 acre and a permanent sewer easement of 0.28 acre across Assessor's Parcel
No.110-200-08, which is vacant raw land located on the east side of Argyle Road opposite
intersection with Forest Hills Drive; and
WHEREAS, a public hearing to consider the adoption of this resolution of necessity
was duly and properly noticed to commence at the regular meeting of the City Council,
1313 California Street, Redding, California, on December 3, 1996; and �

WHEREAS, all legal prerequisites to the adoption of this resolution of necessity �
have occurred, including compliance with the California Environmental Quality Act, in �
connection with the project development for which the property is to be acquired; `

NOW, THEREFORE, THE CITY COUNCIL FINDS, RESOLVES, �
DETERMINES AND ORDERS AS FOLLOWS:

1. The foregoing recitals are true and correct.
2. At its meeting on August 7, 1996, the Board of Administrative Review, based on
an initial study prepared by the Development Services Department, found that the
project has no substantial impact upon the environment and that an environmental
impact report is not necessary. The Board of Administrative Review made its
decision on the basis of the following findings:
a. The project is compatible with the Redding General Plan.
b. The project will not significantly alter existing land form.
c. The project is compatible with surrounding land use.
d. The project is compatible with the Code of the City of Redding,
California.
3. The real property interests sought to be acquired by eminent domain include a �+i-�
temporary construction easement of 0.44 acre and a permanent sewer easement of
0.28 acre (hereinafter collectively called "real property").
4. The taking of said real property is necessary in order to provide for the orderly
extension of sewer to existing and future development, and to eliminate a public
health hazard caused by failing septic systems in the area.
5. Government Code section 37350.5 authorizes the City to acquire the necessary real
property for said public improvements by eminent domain.
6. The real property is described in Elcliibits A and shown on Exhibits B attached
hereto and made a part hereof; owned by one-third by Douglass and Ramona Fraser,
one-third by Bruce and Louise Fraser, and one-third by Margot Fraser Dehoff; and
located on the east side of Argyle Road opposite intersection with Forest Hills Drive,
Redding, Shasta County, California; APN 110-220-08.
7. The City Council finds and determines that:
(a) the public interest and necessity require the project;
(b) the project is planned or located in the manner that will be most compatible
with the greatest public good and the least private injury;
(c) the real property described in this resolution is necessary for the project; and
(d) the offer required by Section 7267.2 of the Government Code has been made
to the owners of record as set forth in Elchibit C attached hereto and made
a part hereof.
8. Susan Hinz is authorized, empowered and directed, in the name of and on behalf
of the City of Redding, to commence an action or actions in eminent domain in the
S�perior Court of the State of California, County of Shasta, to acquire the above-

mentioned real property, and to incur all necessary obligations and expenses
therefor, to be paid by Sun Oaks Racquet Club.
9. The City Clerk is directed to cause a certified copy of this resolution to be recorded
in the office of the Shasta County Assessor/Recorder.

Sun Oaks Racquet Club Sewer Line Extension, A.P. No. 110-220-08
Dear Property Owners:
The City of Redding requested Sun Oaks Racquet Club, as condition for approval of a
building permit, to connect their facility to the Clover Creek Sewer line. Since this connection
requires an easement through a portion of your property, the City Council, on October 1, 1996,
approved the use of the City's power of eminent domain for this easement if Sun Oaks was unable
to negotiate a resolution of this matter with you. Over the past several months, Sun Oak's right of
way agent,Robert Martin, has worked with your representative, Mr. Gordon Fraser, in an effort to
reach agreement for the purchase ofthe required easement and a tempo�ary construction easement
described in E�chibits "A" and shown in the sketches designated Exhibits "B" attached.
Despite these efforts to conclude negotiations, it appears an impasse has been reached and
that the City must initiate steps to acquire the easement.
The just compensation of EIGHT THOUSAND SIX HUNDRED DOLLARS ($8,600)
which the City is offering is the fair market value based on an appraisal of the property prepared by
Ryau&Associates, independent appraisers. A written statement and siwimary of the basis for this
determination is attached hereto as Exlubit "C". This sum is believed by the City to be the fair market
value of the easement and thus just compensation. The City has based its determination of just
compensation on its inspection of the property and its consideration of the above appraisal. In the

opinion ofthe City, the just compensation offered to you for this property interest complies with the
definition of fair market value recognized by tlle courts of the State of California and used by the City
and its appraisers in making their determination of just compensation. Mr. Martin has e�cplained
negotiations and communications are cumbersome since there are tllree separate interests in this
property. He would like to continue to work with you to achieve a resolution of tbis matter. It is
important at this time, due to unpending fall and winter rains, to get the contractor started on the
sewer construction.
Ifyou have any questions regarding any ofthe above,please feel free to call me at (916) 225-
4050. If it is your decision to accept the City's offer for this property, please sign the enclosed
acceptance and return the same in the envelope provided. If we do not receive your written
acceptance of our offer,it will be necessary to recommend that eminent domain proceedings be used
to acquire this property.
NOTICE OF HEARING ON DEC�MBER 3, 1996
In the event you do not wish to accept the City's offer for the above property, please be advised that
it is the present intention of the City of Redding to adopt a Resolution of Public Necessity to acquire
the above mentioned real property interests owned by you, legal descriptions and sketches of which
are attached hereto.
The City Council will hold a hearing priar to consideration of adoption of the proposed
resolution on Tuesday,December 3, 1996 at 7:00 p.m., or as soon thereafter as the Council may hear
it, in the City of Redding City Council chambers located at 1313 Califomia Street, Redding,
California 96001. At such time and place, if you have requested a hearing in writing, you will have
the right to appear and be heard on the following matters:
Whether the public interest and necessity require the project;
Whether the project is planned or located in a manner that will be most compatible with the
greatest public good and least private injury; and
Whether the property interests to be acquired are necessary for the project.
Your faih�re to file a written request with the City Clerk within fifteen (15) days from the date
hereofrequestmg an appearance and the opportunity to be heard on December 3, 1996 will result in
a waiver of your right to be heard.

LEGAL DESCRIPTION
All that portion of the Northwest one-quarter of Section 10, Township 31 North, Range 4 West,
MDM, lying Northeasterly of the centerline of the right of way described in the deed to the State
of California, recorded in the office of the County Recorder May 13, 1943 in Book 137 of Officiai
Records at page 306, Shasta County Records, more particularly described as follows:
A strip of land 20 feet in width the centerline of which is d�scribed as follows:
COMI�fENCING at a point on the North-south Mid-Seckion line of said Section 10, said point
marked by a 5/8" rebar with aluminum cap marked L.S. 4736 and being the southwest corner of
Parcel 2 as shown on Parcel Map No. 778-78 for Shasta Glenn Enterprises, a Limited Partnership
filed for record October 4, 1979 in Book 19 of Parcel Maps at page 65, Shasta County Records,
thence North OS°46'06" West a distance of 102.53 to a point on the existing sewerline lying within
that certain public service easement as described in Book 2759 of Official Records at page 443,
Shasta County Records, and the Point of Beginning of this description; thence WEST a distance
of 10.50 feet; thence from a tangent bearing South 18°52'21" East, along a curve to the right
having a radius of 200.00 feet, a central angle of 18°47'26" an arc length of 65.59 feet to a point
that is 10.00 feet westerly of said north-south mid-section line; thence South 00°04'S5" West a
distance of 252.54 feet to a point that is 10.00 feet westerly of the East line of the land described
in the Deed to Douglas Fraser et al dated July 18, 1988 and recorded October 6, 1988 in Book
2434 of Of�cial Records at page 99, Shasta County Recorder; thence South 64°37'48" West a
distance of 272.21 feet, more or less, to the West line of said Fraser property (2434 OR 99) and
the point of ternunation of this line.
Containing 12,037 square feet, more or less.
The sidelines of said easement are to be lengthened or shortened so as to begin on the wesierly
line of said Public Servic�Easement describeti in Book 2759 of Official Records at page 443,
Shasta County Records and terminate in Argyle Road.
