A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDDING
FINDING THAT PUBLIC INTEREST AND NECESSITY REQUIRE THE
ACQUISITION OF CERTAIN REAL PROPERTY INTERESTS FOR
TEMPORARY AND PERMANENT EASEMENTS FOR NECESSARY
PUBLIC IMPROVEMENTS, NAMELY THE DANA DRIVE ROAD
WIDENING PROJECT (PROJECT).
THE PROPERTY IS OWNED BY JOSEPH M. GYVES AND CONNIE L.
GYVES, AND LOCATED AT THE NORTHWEST CORNER OF VICTOR
AVENUE AND DANA DRIVE, REDDING, SHASTA COUNTY,
CALIFORNIA; APN 071-260-33.
WHEREAS, the Redding Planning Commission, on January 9, 1996, issued Use
Perniit#44-95 to Wal-Mart Stores, Inc., granting approval for construction of a 227,000
square foot commercial complex along Dana Drive south of Costco and north of State
Highway 44; and
WHEREAS, the use permit was granted subject to 49 conditions, including
condition#15(a) requiring the developer to acquire right-of-way and widen Dana Drive to
four lanes from the project's east boundary line to Victor Avenue; this condition further
states that, subject to the approval of the City Council, the City will provide its power of
eminent domain for acquisition; and
WHEREAS, a public hearing to consider the adoption of this resolution of necessity
was duly and properly noticed to commence at the regular meeting of the City Council,
1313 California Street, Redding, California, on December 3, 1996; and
WHEREAS, all legal prerequisites to the adoption of this resolution of necessity
have occurred, including compliance with the California Environmental Quality Act, in
connection with the project development for which the property is to be acquired; �
NOW, THEREFORE, THE CITY COUNCIL FINDS, RESOLVES, �
DETERMINES AND ORDERS AS FOLLOWS: �

2. At its meeting on November 29, 1995, the Board of Administrative Review, based
on an initial study prepared by the Development Services Department, found that
the project has no substantial impact upon the environment and that an
environmental impact report is not necessary. The Board of Administrative Review
made its decision on the basis of the following findings:
a. The project is compatible with the Redding General Plan.
b. The project will not significantly alter existing land form.
c. The project is compatible with surrounding land use.
d. The project is compatible with the Code of the City of Redding,
California.
e. Mitigation measures as attached have been incorporated into the
project to reduce impacts to less than a significant level.
3. The real property interests sought to be acquired by eminent domain include a �+i-�
temporary easement of 925 square feet; a permanent easement of 1413 square feet;
and a public service and slope easement of 524 square feet (hereinafter collectively
called "real property").
4. The taking of said real property is necessary in order to:
(a) Implement the objectives of the Dana Drive road widening project, which
coincides with the construction of the 127,000 square foot Wal-Mart store;
(b) Construct and maintain the project to provide a logical, safe and efficient
arterial street network within the area encompassed by the Dana Drive
Benefit District;
(c) Mitigate traffic congestion;
(d) Control storm drainage;
(e) Accommodate signal construction; and
(� Provide for the continued development of the City's east-central
commercial/residential area encompassed by the project.
5. Government Code section 37350.5 authorizes the City to acquire the necessary real
property for said public improvements by eminent domain.
6. The real property is described in E�ibits A and shown on Exhibits B attached
hereto and made a part hereof; owned by Joseph M. Gyves and Connie L. Gyves,
his wife, as joint tenants; and located at the northwest corner of Victor Avenue and
Dana Drive, Redding, Shasta County, California; APN 071-260-33.
7. The City Council fmds and determines that:
(a) the public interest and necessity require the project;
(b) the project is planned or located in the manner that will be most compatible
with the greatest public good and the least private injury;

(c) the real property described in this resolution is necessary for the project; and
(d) the offer required by Section 7267.2 of the Government Code has been made
to the owners of record as set forth in Exhibit C attached hereto and made
a part hereof.
8. Susan Hinz is authorized, empowered and directed, in the name of and on behalf
of the City of Redding, to commence an action or actions in eminent domain and
obtain a three-day immediate order of possession in the Superior Court of the State
of California, Counry of Shasta, to acquire the above-mentioned real property, and
incur all necessary obligations and expenses therefor, to be paid by Wal-Mart
Stores, Inc.
9. The City Clerk is directed to cause a certified copy of this resolution to be recorded
in the office of the Shasta County Assessor/Recorder.
I HEREBY CERTIFY that the foregoing resolution was introduced, read and
adopted at the regular meeting of the City Council of the City of Redding on the 3rd day
of December, 1996, by the following two-thirds vote:

Dear Mr. and Mrs Gyves:
Over the past several months, our right of way agent, Robert Martin, and you have been
negotiating the terms and conditions for the City of Redding's proposed acquisition of a portion of
your property for a temporary construction easement and street right of way easement to widen Dana
Drive. This property is described in Exhibits A a.nd shown in the sketches designated E�chibits B
attached.
Despite tliese efforts to conclude negotiations, it appears an impasse has been reached and
that the City must initiate steps to acquire the property.
The just compensation of TWENTY THOUSAND TWO HCTNDRED DOLLARS ($20,200)
which the City is offering is the fair market value based on an approved appraisal of the property
prepared by Ryan &Associates, independent appraisers. A written statement a.nd summary ofthe
basis for this determination is attached hereto as Exlubit C. T�is sum is believed by the City to be the
fair market value of the property and thus just compensation. The City has based its deternunation
of just compensation on its inspection of the property and its consideration of the above appraisal.
In the opinion of the City, the just compensation offered to you for this property complies with the
defmition of fair market value recogvized by the courts of the State of California and used by the City
and its appraisers in making their determination of just compensation.

acceptance of our offer,it will be necessary to recommend that eminent domain proceedings be used
to acquire this property.
NOTICE OF HEARING ON TUESDAY, DECEMBER 3, 1996
In the event you do not wish to accept the City's offer for the above property, please be
advised that it is the present intention of the City of Redding to adopt a Resolution of Public
Necessity to acquire the above mentioned real property interests owned by you, legal descriptions and
sketches of which are attached hereto.
The City Council will hold a hearing prior to consideration of adoption of the proposed
resolution on Tuesday,December 3, 1996 at 7:00 p.m., or as soon thereafter as the Council may hear
it, in the City of Redding City Council chambers located at 1313 California Street, Redding,
California 96001. At such time and place, if you have requested a hearing in writing, you will have
the right to appear and be heard on the following matters:
Whether the public interest and necessity require the project;
Whether the project is planned or located in a manner that will be most compatible with the
greatest public good and least private injury; and
Whether the property interests to be acquired are necessary for the project.
Your failure to file a written request with the City Clerk within fifteen(15) days from the date
hereofrequestmg an appearance and the opportun.ity to be heard on December 3, 1996 will result in
a waiver of your right to be heard.
