A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
REDDING SU1VIlVIARILY VACATING A 10.00 FOOT WIDE
WATERLINE EASEMENT LOCATED AT 5051 CATERPILLAR ROAD.
WHEREAS, the 10.00 foot wide water easement described in Exhibit A and shown on
the map attached hereto and made a part hereof (hereinafter referred to as the "Easement") was
acquired by the City of Redding through the Buckeye annexation; and
WHEREAS, when the land was developed into a commercial subdivision, Prestige
Way was used to carry all the utilities, including the waterline; and
WHEREAS, the property owner has requested the abandonment of the Easement,
which has never been used; and
WHEREAS, the Public Works Department has confirmed that the Easement has not
been used since it was established, and has advised the City Council that no future use is
anticipated, nor are there in-place public utility facilities that are in use or would be affected
by vacating the Easement; �
NOW, THEREFORE, THE CITY COUNCIL RESOLVES AND ORDERS AS �

l. The City Council elects to proceed in this matter under the provisions of the Public
Streets, Highways and Service Easements Vacation Law as set forth in Section 8330, et
seq., of the Streets and Highways Code of the State of California.
2. The Easement is not being used and there are no in-place public utility facilities located
therein.
3. The City Council approves the request to summarily vacate the Easement, as more
particularly described in Exhibit A and the map attached hereto.
4. The City Clerk is directed to cause a certified copy of this resolution of vacation,
attested by the Clerk under seal, to be recorded in the office of the Shasta County
Assessor/Recorder.
5. From and after the date this resolution is recorded, the Easement hereby vacated shall
no longer constitute a waterline easement.
I HEREBY CERTIFI' that the foregoing resolution was introduced, read and adopted
at a regular meeting of the City Council on the 3rd day of December , 1996, by the
following vote:
