A RESOLUTION OF THE CITY COUNCII. OF THE CITY OF
REDDING SUNIlVIARILY VACATING THE EASEMENT GRANTED BY
B.C. FOSTER TO PACIFIC GAS AND ELECTRIC AND PACIFIC
TELEPHONE AND TELEGRAPH COMPANY ON MAY 10,
1974—SUBSEQUENTLY ASSIGNED TO THE CITY OF REDDING—AND
RECORDED AS DOCUMENT #39221 ON NOVEMBER 14, 1979, IN
BOOK 1679 AT PAGE 368, SHASTA COUNTY RECORDS.
WHEREAS, on May 10, 1974, B.C. Foster granted an Easement to Pacific Gas and
Electric Company (PGandE) and Pacific Telephone and Telegraph Company (PTandT)
(Easement) a copy of which is attached hereto and made a part hereof; and
WHEREAS, the interests of PGandE and PTandT transferred to the City of Redding
through the Enterprise annexation; and
WHEREAS, the current property owner has requested the abandonment of the
Easement, as more particularly described and shown in Exhibits A and B attached hereto and �
made a part hereof; and

WHEREAS, the Public Works Department has advised the City Council that the �
Easement is not being used and there are no in-place public utility facilities that are in use or �
would be affected by vacating the Easement; �

NOW, THEREFORE, the City Council RESOLVES and ORDERS as follows:

1. The City Council elects to proceed in this matter under the provisions of the Public
Streets, Highways and Service Easements Vacation Law as set forth in Section 8330, et
seq., of the Streets and Highways Code of the State of California.
2. The Easement is not being used and there are no in-place public utility facilities located
therein.
3. The City Council approves the request to summarily vacate the Easement, as more
particularly described and shown in attached Exhibits A and B.
4. The City Clerk is directed to cause a certified copy of this resolution of vacation,
attested by the Clerk under seal, to be recorded in the office of the Shasta County
Assessor/Recarder.
5. From and after the date this resolution is recorded, the Easement hereby vacated shall
no longer constitute the right from time-to-time to construct, install, inspect, maintain,
replace, remove and use facilities of the type described therein, together with a right-
of-way therefor, within the strip or parcel of land or along the route set forth therein,
and also ingress thereto and egress therefrom, over and across said lands.
I HEREBY CERTIFY that the foregoing resolution was introduced, read and adopted
at a regular meeting of the City Council on the 3rd day of December , 1996, by the

T. 31 N., R. 4 W., M.D.B.&M., described as beginning at the northeast
corner of the parcel of land conveyed by Tom A. Baldwin to Dorothy
Baldwin by deed dated June 15, 1964, and recorded in Book 792 of Official
Records at page 547, Shasta Counry Records, and running south 0°30'31"
west along the easterly boundary and its southerly prolongation thereof of
the lands conveyed by said deed dated June 15, 1964, 210 feet; thence
leaving said southerly prolongation and running south 89°10'S0" east 150
feet; thence north 0°30'31" east 210 feet; thence north 89°10'S0" west 150
feet to the point of beginning.
