A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDDING
DISESTABLISHING REDDING MIDTOWN MALL PROJECT NO. 1,
BENEFIT ASSESSMENT DISTRICT NO. 1993-1, UPON PETITION OF A
WEIGHTED MAJORITY OF THE PROPERTY OWNERS SUBJECT TO
ASSESSMENT
WHEREAS,the City Council of the City of Redding("City Council") adopted Resolution
No. 93-296 on July 20, 1993, which noticed its intention to establish a benefit assessment district
pursuant to the Benefit Assessment Act of 1982 (Gov. Code section 54703 et seq.); and
WHEREAS, Government Code section 54720 specifically authorizes the City Council to
form the Redding Midtown Mall Project No. 1 as an area of benefit and to levy a benefit
assessment for the operation and maintenance of the Redding Midtown Mall Project No. 1; and
WHEREAS, after having conducted two public hearings noticed pursuant to Government
Code sections 54716(b) and 6066, the City Council adopted Resolution No. 93-332 on September
7, 1993, which established the Redding Midtown Mall Project No. 1, Benefit Assessment District
1993-1 ("District") subject to the affirmative vote of a simple majority of the square footage of the
parcel size within the District; and
WHEREAS, Resolution No. 93-332 established the physical boundaries of the District
and levied an assessment of three (3) cents per square foot for each benefited parcel per month in
order to fund the operation and maintenance of the Midtown Mall Project No. 1; and
WHEREAS, the City Council adopted Resolution No. 93-333 on September 7, 1993,
thereby setting a special mailed ballot election on September 28, 1993, for a vote on the question
of the formation of the District and the levy of an assessment in the amount of three (3) cents per
square foot of each parcel size per month; and
WHEREAS, the City Council adopted Resolution No. 93-358 on October 5, 1993, which
confirmed the results of the election in favor of formation of the District and ordered the City Clerk
to record a copy of the diagram of the District and a notice of assessment with the County
Recorder; and
WHEREAS, on February 2, 1993, the City Council adopted Resolution No. 93-39 which
approved the "Agreement for Operation and Maintenance of the Downtown Mall" with the
Midtown Mall Benefit Corporation, Inc.; and

WHEREAS, upon formation of the District, and at every time since formation, the a
Midtown Mall Benefit Corporation, Inc., has operated and maintained the Midtown Mall Project
No. 1 with funding derived, in whole or in part, by assessments levied in the District; and G

WHEREAS, the project area of Midtown Mall Project No. 1 has, since its initial
formation, undergone significant redevelopment; and
WHEREAS, in light of such redevelopment, City staff commenced meetings with
property owners within the District and members of the Midtown Mall Benefit Corporation, Inc.,
in order to address ongoing and future needs with regard to the Project area; and
WHEREAS, a poll of the ownership within the District was made and the results of the
poll indicated that the weighted majority of the property owners expressed a preference to
disestablish the District and to thereafter consider possible formation of a Landscape Maintenance
District and/or a Business Improvement District; and
WHEREAS,a petition in favor of disestablishment of the District, attached as Exhibit A to
this Resolution, has been submitted by a weighted majority of the property owners within the
District who are subject to the assessment; and
WHEREAS, the notice of the public hearing conducted on the date of adoption of this
Resolution was published by the City Clerk pursuant to Government Code sections 54716(b) and
6066 and each property owner within the district was also individually noticed;
NOW, THEREFORE, IT IS RESOLVED that the City Council of the City of Redding
does hereby find, determine and order as follows:
1. Notice as required by law has been given.
2. All persons requesting to be heard at public hearing have been given the opportunity to be
heard.
3. That a weighted majority of the owners within the District subject to the assessment have
petitioned the City Council to disestablish the District.
4. That said petitions shall be considered as affirmative votes in favor of disestablishment;
there being no expressed opposition by owners subject to assessment to the contrary.
5. That the District is hereby disestablished and any levy adopted for the District shall cease
as of the date of adoption of this Resolution.
6. That this action is exempt from the provisions of the California Environmental Quality Act
in that adoption of this resolution shall not cause a significant impact to the environment.
7. That a certified copy of this Resolution shall be recorded in the Office Records of the
County of Shasta so as to remove encumbrances on title resulting from formation of the
District.
8. That City staff are hereby directed to use best efforts to coordinate with owners of record
within the former boundaries of the District, and any properties adjacent to the former
District if applicable, in order to facilitate the establishment of an assessment district based
financing as may be desired by persons/entities that may be subject to assessment.

certain public streets and rights-of-way,and development of parcels for residential and/or commercial
purposes;and
WHEREAS,we the undersigned further understand that,due to these significant changes,the existing
benefit assessment is no longer viable as a means to maintain the District's common area and is unlikely
to accommodate the construction of improvements and maintenance of existing and future
improvements within the District which would specifically benefit the owners therein;and
WHEREAS,we the undersigned further petition the City Council to direct staff to work with the District's

WHEREAS,on September 7,1993,the City Council of the City of Redding adopted Resolution No.93-332
thereby establishing the Midtown Mall Project No. 1,Benefit Assessment District No. 1993-1("District");
and
WHEREAS,by Agreement effective May 17,2011,the City of Redding and the Midtown Mall Benefit
Corporation, Inc.restated its agreement to apportion maintenance of defined common areas within the
District;and
WHEREAS,we the undersigned recognize that portions of the commercial areas and most of the
common area within District have undergone significant changes largely relating to existing and
anticipated improvements within the District including,but not limited to,the reestablishment of
certain public streets and rights-of-way,and development of parcels for residential and/or commercial
purposes;and
WHEREAS,we the undersigned further understand that,due to these significant changes,the existing
benefit assessment is no longer viable as a means to maintain the District's common area and is unlikely
to accommodate the construction of improvements and maintenance of existing and future
improvements within the District which would specifically benefit the owners therein;and
WHEREAS,we the undersigned further petition the City Council to direct staff to work with the District's
property owners to research the viability of establishing a landscape maintenance district,property-
based improvement district,business improvement district or combination of the three with the
intention of accommodating future capital improvements including,but not limited to,streetscape,
lighting and park maintenance beyond City general maintenance and security.
