WHEREAS, that portion of the Akard Avenue right-of-way lying between Cypress Avenue and Parkview Avenue, as described in E�ibit A and shown as the "Area of Abandonment" on the Location Map attached hereto and made a part hereof, is within the City of Redding public street system; and WHEREAS, the proposed vacation of that portion of the Akard Avenue Right- of-Way lying between Cypress Avenue and Parkview Avenue is necessary to facilitate development of the site plan preferred by the City Council for the Civic Center Project � ("Project"); and ` WHEREAS, on September 17, 1996, by Resolution 96-173, the City Council �� declared its intention to vacate the Area of Abandonment; and � WHEREAS, the City Council, at its meeting of October 16, 1996, adopted a ' negative declaration, including a specific traffic impact study, ' identifying the traffic � � ' ` , � . • • • impacts resulting from the proposed vacation and the reasonable mitigations to bring said traffic impacts to a level of insignificance; and WHEREAS, the traffic mitigation measures identified in the negative declaration are incoXporated into the Project; and WHEREAS, the proposed vacation does not affect any easements for existing public utilities or public services located within the Area of Abandonment; and WHEREAS, the proposed vacation will not become effective until this resolution is recorded as set forth below; and WHEIYEAS, the City Council finds and determines that, subject to the conditions hereinafter set forth, the Area of Abandonment is unnecessary for present or prospective public use; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF REDDING FINDS, RESOLVES AND ORDERS AS FOLLOWS: 1. Proceedings have been duly conducted and held in accordance with the provisions of the Public Streets, Highways, and Service Easements Vacation Law, Streets and Highways Code Section 8300, et seq. 2. The Council makes the following findings in connection herewith: (a) The Project is compatible with the Redding General Plan; ��ll �'1P �1'f11Pf`t !,1/�� Il�t Cl�IiSC..aa.�.41�' .a..��vi u�iv v�:u��u b �.�..n� ��i:�:i� J ' (c) The Project is compatible with surrounding land use; and (d) The Project is compatible with the Redding Municipal Code. 2. That portion of the Akard Avenue right-of-way lying between Cypress Avenue and Parkview Avenue, as described in E�iibit A and shown as the "Area of Abandonment" on the Location Map attached hereto, is vacated, SUBJECT TO the following: (a) Retention or relocation of existing easements for public utilities or public services located within the Area of Abandonment. (b) Incorporation of the traffic mitigations identified in the adopted negative declaration, as follows: i. The construction of a median in Cypress Avenue at the intersection of Grape Street, prohibiting left-turn movements, with completion of the Civic Center Project; ii. The intersection of Parkview Avenue and Park Marina Drive must be monitored and likely signalized by the year 2010; and iii. The intersection of Parkview Avenue and Market Street must be monitored and likely signalized by the year 2020. _ . _. _ ... _ .. _ 2 . _. _. . . (d) Preparation and submittal to the City Council of a report by the Public Works Department of its recommendations for the addition of left-turn signal phases at the intersection of Cypress Avenue, Athens Avenue, and Park Marina Drive to align Athens Avenue and Park Marina Drive at Cypress Avenue. 3. Upon completion of the Project, as verified by the City Manager, the City Clerk is directed to record a certified copy of this resolution, attested by the Clerk under seal, in the office of the Shasta County Assessor/Recorder. Until such time, this resolution is not to be recorded.
