HomeMy WebLinkAboutReso 97-60 - LMD "C" ., � � RESOLUTION NO. 97 C��(J LANDSCAPE MAINTENANCE DISTRICT "C" A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDDING APPROVING THE REPORT OF THE ENGINEER AS FILED, AND DECLARING ITS INTENTION TO: (1) ANNEX iTNIT 1 AND REMAINING PARCEL R-1 OF THE FAIRWAY ESTATES SUBDIVISION INTO AREA 7 OF THE DISTRICT; (2) LEVY AND COLLECT ASSESSMENTS FOR FISCAL YEAR 1997/98 PURSUANT TO TI�LANDSCAPING AND LIGHTING ACT OF 1972, COMMENCING WITH SECTION 22500 OF THE STREE�S AND �-IIGHWAYS CODE; AND (3) ADOPT A SC�IEDULE OF ANNUAL INCREASES FOR FUTURE ASSESSMENTS. WHEREAS, the City Council heretofore ordered the consolidated formation of Landscape Maintenance District "C" (District) under authority granted by the Landscaping and Lighting Act of 1972, as set forth in Part 2 of Division 15 of the Streets and Highways Code of the State of California; and WHEREAS, the purpose of the District is to provide maintenance to those landscaping improvements required within the public rights-of-way by the conditions of development approval of the subdivisions contained therein; and WHEREAS, no substantial changes in existing improvements are proposed for fiscal year 1997/98; and WHEREAS, the Engineer has filed his Report with the City Clerk pursuant to Streets and Highways Code Section 22565, et seq.; � �-. NOW, THEREFORE, BE IT RESOLVED by the City Council that: ��j 1. The Report of the Engineer, as filed, is hereby approved. �\ \ `� 2. It is the intention of the City Council to: �. � � � (a) Annex Unit 1 and Remaining Parcel R-1 of the Fairway Estates Subdivision into Area 7 of the District; and (b) Levy and collect assessments for fiscal year 1997/98 equally amongst all the lots and remaining parcels that encompass the District, which lots and parcels are more particularly described in the diagrams and location maps attached hereto and made a part hereof, except that it sha11 not impose an assessment upon a federal or state governmental agency or another local agency. 3. 'The existing improvements for each subdivision in the District are set forth under the attached column entitled "Landscaping Description and Square Footage." 4. The general location of the lots and parcels in the District are set forth under the attached column entitled "Access/Location." 5. The Report of the Engineer, on file with the City Clerk, contains a full and detailed description of the improvements, the boundaries of the District—including the area proposed to be annexed in—and any zones therein, and the proposed assessments upon the assessable lots and remaining parcels within the District. 6. No substantial changes in existing improvements are proposed for fiscal year 1997/98. Only costs for the maintenance of landscaping, miscellaneous lighting, mulching (if any), vandalism, repairs to the irrigation system, electric and water charges, replacement of vegetation as necessary, and any and a11 incidental expenses, including administrative costs, in connection therewith will be assessed. 7. A public meeting will be held on Tuesday, May 6, 1997, and a public hearing on Tuesday, May 20, 1997, at the hour of 7:00 p.m., or as soon thereafter as the matter may be heard, in the City Council Chambers located at 1313 California Street, Redding, California, to address the proposed annexataion of additional territory into the District and the levy of the proposed assessment for fiscal year 1997/98. 8. The proposed assessment of $8.00 is an increase over last year's assessment of $7.46. 9. The City Council is considering adopting a schedule of annual increases for future assessments, in which: (a) The proposed 1997/98 assessment shall increase by up to four percent (4%) per year at a compounded rate. 2 � • (b) The reserve fund for the District should not exceed 100 percent (100%) of the total District budget. When the funds exceed this reserve, the excess funds should be spent on District landscape enhancement based on a consensus of opinion from the lot/parcel owners, who will be polled by mail. This consensus will also be used to deternvne if the lot/parcel owners should get a refund. (c) The City's administrative costs to manage the District shall not exceed four percent (4%) of the annual assessment in any year.
