RESOLUTION NO. 97-��
LANDSCAPE MAINTENANCE DISTRICT "C"
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDDING:
(1) ORDERING THE ANNEXATION OF iJNIT 1 AND REMAINING
PARCEL R-1 OF THE FAIRWAY ESTATES SUBDIVISION INTO
THE DISTRICT AS AREA 7;
(2) CONFIRMING THE ASSESSMENT DIAGRAM;
(3) ORDERING THE LEVY OF THE ANNUAL ASSESSMENTS FOR
FISCAL YEAR 1997/98 PURSUANT TO THE LANDSCAPING AND
LIGHTING ACT OF 1972 (COMMENCING WITH SECTION 22500 OF
THE STREETS AND HIGHWAYS CODE); AND
(4) ADOPTING A SCHEDULE OF ANNUAL INCREASES FOR FUTURE
ASSESSMENTS.
WHEREAS, on April 1, 1997, the City Council approved the Report of the Engineer as
filed relating to Landscape Maintenance District "C" (District), and gave notice of the time and
place of the May 20, 1997, public hearing regarding the levy and collection of assessments for fiscal
year 1997/98 and the proposed schedule of annual increases for future assessments; and
WHEREAS, the City Council also gave notice of its intention to annex additional territory,
namely Unit 1 and Remaining Parcel R-1 of the Fairway Estates Subdivision into the District as
Area 7; and
WHEREAS, a diagram of the area encompassed by the District, including the area proposed
to be annexed in, individual maps, and a summary are attached and made a part hereof; and
WHEREAS, the public hearing, duly and properly noticed, commenced at the City Council
Chambers, 1313 California Street, Redding, California, on May 20, 1997, and was concluded prior
to the adoption of this resolution; and
WHEREAS, at the May 20 public hearing, the City Council gave every interested person an
opportunity to object to the proposed assessments; and
WH�REAS, all legal prerequisites to the adoption of this resolution have occurred,
including a public meeting held May 6, 1997;
NOW, THEREFORE, THE CITY COUNCIL FINDS, RESOLVES, DETERMINES
AND ORDERS AS FOLLOWS:

1. The matters set forth above are true and correct.
2. With respect to the additional territory proposed to be annexed into Landscape Maintenance
District "C":
(a) The owners of the land within the boundaries of the additional territory proposed to
be annexed into the District have filed their Petition and Consent to said inclusion;
and have waived the resolutions, engineer's report, notices of hearing, and the right
of a majority protest with regard to the area proposed to be annexed as provided by
Section 22608 of the Streets and Highways Code.
(b) Said territory is described as follows:
All of that certain real property situate in the City of Redding, Shasta County,
California, being I,ots 1-52 inclusive and Parcel R-1 of the Fairway Estates
Subdivision, as shown on the Map recorded November 27, 1996, in Book 21 of Maps
at page 92, Shasta County Records (previously APN 073-460-01-39; 073-470-01-13).
(c) The City Council hereby orders the annexation of said additional territory into
Landscape Maintenance District "C" as Area 7 for the maintenance of landscaping,
miscellaneous lighting, mulching, vandalism, repairs to the irrigation system, electric
and water charges, replacement of vegetation as necessary, and any and all incidental
expenses, including administrative costs, in connection therewith, all as more
particularly authorized pursuant to the Landscaping and Lighting Act of 1972.
3. The assessment diagram contained in the Engineer's Report is confirmed.
4. The City Council has considered all oral statements and written protests or communications
made or filed by interested persons at the public meeting of May 6, 1997, and the public
heari�ng of May 20, 1997, and expressly overrules any and all protests filed objecting to the
proposed assessments to be levied in the District and the schedule of annual increases for
future assessments.
5. The City Council finds that the Engineer has fairly and properly apportioned the cost of the
improvements to each lot/remaining parcel of land in the District (including the above area
annexed in as Area 7) in proportion to the estimated benefits to be received by each
lot/remaining parcel from the improvements.
6. An assessment of $8.00 against each lot and remaining parcel located within the District for
fiscal year 1997/98 is adopted and confirmed, except that an assessment shall not be levied
on property owned by a federal or state governmental agency or another local agency.
7. A schedule of annual increases for future assessments is hereby adopted, in which:
(a) The proposed 1997/98 assessments shall increase by up to four percent (4%) per year
at a compounded rate.

(b) The reserve fund for the District should not exceed 100 percent (100%) of the total
District budget. When the funds exceed this reserve, the excess funds should be
spent on District landscape enhancement based on a consensus of opinion from the
lot/parcel owners, who will be polled by mail. This consensus will also be used to
determine if the lot/parcel owners should get a refund.
(c) The City's administrative costs to manage the District shall not exceed four percent
(4%) of the annual assessments in any year.
8. The City Clerk shall forthwith transfer to the Auditor and the Assessor/Recorder of Shasta
County a certified copy of this resolution and a certified copy of the assessment diagram
contained in the Engineer's Report.

regular meeting of the City Council on the 20th day of May, 1997, by the following vote:
