A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
REDDING RATIFYING THE CITY MANAGER AWARD OF AN
EMERGENCY CONSTRUCTION CONTRACT TO REPAIR A
DAMAGED WATER MAIN SOUTH OF GIRVAN ROAD
WHEREAS, Public Contract Code section 22050 and Redding Municipal Code
4.22.120(A) provide that, in the case of emergency, a public agency may repair or replace
a public facility, take any directly related and immediate action required by that emergency,
and procure the necessary equipment, services, and supplies for those purposes without giving
notice for bids to let contracts; and
WHEREAS, on or about August 21, 2020, staff was made aware that the 16-inch
water main south of Girvan Road and located within an easement in North State
Recycling's yard failed; and
WHEREAS, the water main delivers water to the southern end of the Cascade Water Zone;
and
WHEREAS, a competitive solicitation for bids will delay the repairs needed to prevent
further damage and to restore water service back to residences and businesses; and
WHEREAS, further failure of the water main would threaten the health, safety and
property of public nearby because failure of the water main could damage private and/or public
property and would drastically limit available water supply for potable use as well as limit water
supply available for fire suppression; and
WHEREAS, isolation of the impacted area so that competitive bidding could be
accommodated would not mitigate or eliminate the threat of loss of water and to public health
and safety;
NOW, THEREFORE, BE IT RESOLVED THAT:
1. The City Council of the City of Redding finds that the recitals set forth above are true
and correct and are hereby adopted as findings of fact.
2. The public interest and necessity require the immediate expenditure of public money
to restore the water delivery system, protect the public health, safety and welfare, and
prevent further damage to the area.
3. The City Council of the City of Redding therefore ratifies the City Manager's
award of an emergency construction contract to repair the water main south of Girvan
Road at or near North State Recycling.
4. The action authorized herein shall be reviewed by the City Council at all regular
meetings of the Council until such time as the City Council determines that the
emergency is abated.
I HEREBY CERTIFY that the foregoing resolution was introduced and adopted at a regular
meeting of the City Council of the City of Redding on the 1 st day of September, 2020, by
the following vote:
