HomeMy WebLinkAboutReso 97-112 - Approve the request of Viva Downtown to allow the sale, consumption, and possession of intoxicating Beverages on Public Property in and adjacent to Library Park in conjuction with Marketfest . - • • • RESOLUTION NO. 97- I/ Z A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDDING APPROVING THE REQUEST OF VNA DOWNTOWN TO ALLOW THE SALE, CONSUMPTION, AND POSSESSION OF INTOXICATING BEVERAGES ON PUBLIC PROPERTY IN AND ADJACENT TO LIBRARY PARK 1N CONJUNCTION WITH MARKETFEST. WHEREAS, the City Council has received a request from Viva Downtown to perinit the sale, consumption and possession of alcoholic beverages on public property in and adjacent to Library Park, as depicted in Exhibit A attached hereto, in conjunction with MarketFest; and WHEREAS,Redding Municipal Code Section 6.38.062 A. prohibits the possession and/or consumption of intoxicating beverages on any public property, highway, street, sidewalk, alley or parking lot within the Central Business District, which is defined as the area bordered by Trinity Street, Court Street, East Street, and Sonoma Street extended; and WHEREAS, Redding Municipal Code Section 10.20.040 B.1. also prohibits the possession or consumption of alcoholic beverages within the boundaries of Library Park; and WHEREAS, as required by Council Policy 1201 entitled Policy 13 Re Certairz Uses of City Parks arid Recreational Facilities for Fitnd-Raising Purposes,Viva Downtown has applied to the City for a permit to sell alcoholic beverages within the City park system, which application has been approved by the Recreation and Parks Commission, the Chief of Police, the City Manager, and the Director of Cominunity Services/Recreation and Parks Division; and WHEREAS, Section 6.38.062 D. provides that the City Council, by resolution, may issue a permit allowing the consumption or possession of intoxicating beverages on public streets and the like at any organized event of community-wide interest; and WHEREAS,MarketFest is an organized event of community-wide interest that will include food and beverages, live entertainment, a certified farmer's market, arts and crafts, and children's activities; and WHEREAS it is i•o osed that beer and wine will be sold and consumed at MarketFest, � � P l� which will run for eleven consecutive Thursday evenings from 3:30 to 9:30 p.m., starting July 17 � and ending September 25, 1997; � � NOW,THEREFORE, BE IT RESOLVED that the City Council hereby permits the sale, � consumption a�ld possession of alcoholic beverages within the area depicted in Exhibit A in � conjunction with MarketFest for eleven consecutive Thursday evenings from 3:30 p.m. to 9:30 p.m., , • . • . beginning July 17 and ending September 25, 1997. Pursuant to Council Policy 1201, all beverages must be sei-ved in cans or paper or plastic cups. BE 1T FURTHER RESOLVED that this permit may be revoked at any time by the City Manager. CITY CLERK DATE . • � � Downtown Redding MarketFest Event Concept The Format Regular evening gatherings operating from approximately 4:30 PM to 8:30 PM on Thursdays from July 17, 197 through September 25, 1997. The Location As with last year, MarketFest is scheduled to take place in downtown's Library Park. Planned renovations will expand the park area making the space even more appropriate and accommodating for the MarketFest event. The Elements Farmer's Market: Shasta Grower's Association will conduct a Farmer's Market of approximately 18 vendors each night. Arts/Crafts: Approximately 10 high-quality artists and crafters will have booth space each night. FoodlBeverage: Approximately 8 food booths will be serving hot and cold dishes including barbecue, Mexican, ice cream, hot dogs, and shaved-ice/snow-cones. Soda, juice, beer and wine will also be available. MusiclEntertainment: Live music—with both local and out-of-area performers—will be primarily small groups and individual performers of an acoustic nature. Children's Activities: An activity or presentation focused for children will take place at a specific location on-site. Downtown Plan: A booth staffed by architects and Task Force members will display and describe the Downtown Plan. Event Orqanization and Manaqement The MarketFest is organized and managed by Viva Downtown Redding, the organization formed solely for the purpose of facilitating community, cultural and economic development in downtown. � � � Beer & Wine Policy The MarketFest is designed to be an event where beer and wine can be enjoyed both safely and moderately. Beer and wine will be served to and consumed by adults only and identifications will be checked. 1. No Advertising Permitted: No beer or wine advertising of any kind will be permitted anywhere on the event site. The only brand signage allowed will be that which provides a means for identifying choices for customers and will be displayed only on the inside of the service shelter. 2. No Brand Preference: No specific preference will be given to any beer or wine brand either in the form of sponsorship or in the service of product. 3. Consumption Will Be Controlled: Beer and wine will be priced high deliberately to avoid over-consumption. 4. Service Shelter: Beer and wine will be served only from a service shelter on premise. Consumption will be restricted to the park boundaries. 5. Entry-Exit Control: All points of event entry and exit will be controlled and monitored at all times during event operation by identifiable Event Staff (see Security Procedure 2.) 6. Sales Stoppage: If, in the opinion of the Event Director, beer and wine consumption appears to be or will be excessive on a given evening, beer and wine sales will be stopped immediately for the remainder of the evening. . ' � � Security Procedures The MarketFest will emphasize security and crowd control as a priority. Contract security services and event staff will combine to provide adequate and effective event logistics, control and security. 1. Private Security: Paid, uniformed, private security personnel will be on-duty at all hours the event is open and in operation. 2. Event Staff: Event staff, wearing common clothing, will provide event information and entry/exit control, and will ensure the requirements and policies of the City are followed by event attendees. All event staff will be briefed on crowd-control and event logistics. 3. Redding Police Deparfinent: The Redding Police Department will be asked to increase vehicle patrol in the area during and after event hours. 4. Disruptive Behavior: Disruptive behavior will not be tolerated. Any individual(s) determined by Event Staff to be causing or engaging in disruptive behavior will be asked to leave the event.
