RESOLUTION NO. 97- /�I8 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDDING SUMIVIARII,Y VACATING A 15' WIDE PUBLIC SERVICE EASEMENT AND A 5' WIDE CONSTRUCTION EASEMEN� LOCATED AB' 3055 CI20SSROADS DRIVE. WHEREAS: A. A 15' wide public service easement and a 5' wide construction easement on property located at 3055 Crossroads Drive ("property"), indicated by dotted lines on the map attached hereto and made a part hereof, were acquired by the City of Redding by dedication on Parcel Map LS-7-87, recorded in Book 27 of Parcel Maps at page 28, Shasta County Records. B. The property is located within the boundaries of the Clover Creek Sewer Assessment District; and a sewer line has been installed within the right-of-way of Crossroads � Drive. C. The property owner has requested the abandonment of the 15' wide public service � easement and the 5' wide construction easement as they are no longer required and are � an obstruction to future development of the property. � D. The Public Works Department has confirmed that said easements are not required and � no future use is anticipated, and there are no in-place public utility facilities that are in � use or would be affected by vacating the easements. ����,�35�9PAGE4�� `' � • NOW, THEREFORE, THE CITY COUNCIL RESOLVES AND ORDERS AS FOI.LOWS: 1. The City Council elects to proceed in this matter under the provisions of the Public Streets, Highways and Service Easements Vacation Law as set forth in Section 8330, et seq., of the Streets and Highways Code of the State of California. 2. The 15' wide public service easement and the 5' wide construction easement are not required, and there are no in-place public utility facilities located therein. 3. The City Council approves the request to summarily vacate the 15' wide public service easement and the 5' wide construction easement on the property located at 3055 Crossroads Drive, as shown by the dotted lines on the attached map. 4. The City Clerk is directed to cause a certified copy of this resolution of vacation, attested by the Clerk under seal, to be recorded in the office of the Shasta County Assessor/Recorder. 5. From and after the date this resolution is recorded, the 15' wide public service easement and the 5' wide construction easement hereby vacated shall no longer constitute public service/construction easements.
