RESOLUTION NO. 97- /S �
LANDSCAPE M�IINTENANCE DISTRICT "B"
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDDING:
(1) CONFIRMING THE ASSESSMENT DIAGRAM; AND
(2) ORDERING THE LEVY OF THE ANNUAL ASSESSMENTS FOR FISCAL
YEAR 1997/98 PURSUANT �'O THE LANDSCAPING AND LIGHTING ACT
OF 1972 (COMMENCING WITH SECTION 22500 OF THE STREETS AND
HIGHWAYS CODE).
WHEREAS, on April 1, 1997, the City Council approved the Report of the Engineer as filed
relating to Landscape Maintenance District "B° (District), and gave notice of the time and place of the
May 20, 1997, public hearing regarding the levy and collection of assessments for fiscal year 1997/98 and
the proposed schedule of annual increases for future assessments; and
WHEItEAS, a diagram of the area encompassed by the District, individual maps, and a summary
are attached and made a part hereof; and
WHEREAS, the public hearing, duly and properly noticed, commenced at the City Council
Chambers, 1313 California Street, Redding, California, on May 20, 1997, and was concluded prior to the
adoption of this resolution; and
WHEREAS, at the May 20 public hearing, the City Council gave every interested person an
opportunity to object to the proposed assessments; and
WHEREAS, all legal prerequisites to the adoption of this resolution have occurred, including a
public meeting held May 6, 1997;
NOW, THEREFORE, THE CITY COUNCIL FINDS, RESOLVES, DETERMINES AND
ORDERS AS FOLLOWS:
1. The matters set forth above are true and correct. \

2. The City Council has considered all oral statements and written protests or communications �
made or filed by interested persons at the public meeting of May 6, 1997, and the public �
hearing of May 20, 1997, and expressly overrules any and all protests filed objecting to the �
proposed assessments to be levied in the District. �

3. The assessment diagram contained in the Engineer's Report is confirmed.
4. The City Council finds that the Engineer has fairly and properly apportioned the cost of the
improvements to each lot/remaining parcel of land in the District in proportion to the
estimated benefits to be received by each lot/remaining parcel from the improvements.
5. An assessment of$71.00 against each lot and remaining parcel located within the District for
fiscal year 1997/98 is adopted and confirmed, except that an assessment shall not be levied
on property owned by a federal or state governmental agency or another local agency.
6. Resolution No. 97-91 adopted May 20, 1997, is hereby rescinded and shall have no force or
effect.
7. The City Clerk shall forthwith transfer to the Auditor and the Assessor/Recorder of Shasta
County a certified copy of this resolution and a certified copy of the assessment diagram
contained in the Engineer's Report.
I HEREBY CERTIFY that the foregoing resolution was introduced, read and adopted at a regular
meeting of the City Council on the 19th day of August, 1997, by the following vote:
