RESOLUTION NO. 97-��P>
LANDSCAPE MAINTENANCE DISTRICT "A"
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
REDDING:
(1) ORDERING THE ANNEXATION OF UNIT 4 OF THE LANCER
IIILd,S SUBDIVISION INTO AREA 10 OF THE DISTRICT;
(2) CONFIRMING THE ASSESSMENT DIAGRAM; AND
(3) ORDERING THE LEVY OF THE ANNUAL ASSESSMENTS FOR
FISCAL YEAR 1997/98 PURSUANT TO THE LANDSCAPING
AND LIGHTING ACT OF 1972 (COMMENCING WITH SECTION
22500 OF THE STREETS AND HIGHWAYS CODE).
WHEREAS, on April l, 1997, the City Council approved the Report of the Engineer
as filed relating to Landscape Mainteriance District "A" (District), and gave notice of the time
. and place of the May 20, 1997, public hearing regarding the levy and collection of assess-
ments for fiscal year 1997/98 and the proposed schedule of annual increases for future
assessments; and
WHEREAS, the City Council also gave notice of its intention to annex additional
territory, namely Unit 4 of the Lancer Hills Subdivision, into Area 10 of the District; and
WHEREAS, a diagram of the area encompassed by the District, including the area
proposed to be annexed in, individual maps, and a summary are attached and made a part
hereof; and
WHEREAS, the public hearing, duly and properly noticed, commenced at the City
Council Chambers, 1313 California Street, Redding, California, on May 20, 1997, and was
concluded prior to the adoption of this resolution; and
WHEREAS, at the May 20 public hearing, the City Council gave every interested �
person an opportunity to object to the proposed assessments; and

WHEREAS, all legal prerequisites to the adoption of this resolution have occurred, �
including a public meeting held May 6, 1997; \
NOW, THEREFORE, THE CITY COUNCIL FINDS, RESOLVES, �
DETERMINES AND ORDERS AS FOLLOWS:

1. The matters set forth above are true and correct.
2. With respect to the additional territory proposed to be annexed into Landscape
Maintenance District "A":
(a) The owner of the land within the boundaries of the additional territory proposed
to be annexed into the District has filed her Petition and Consent to said
inclusion; and has waived the resolutions, engineer's report, notices of hearing,
and the right of a majority protest with regard to the area proposed to be
annexed as provided by Section 22608 of the Streets and Highways Code.
� (b) Said territory is described as follows:
All of that certain real property situate in the City of Redding, Shasta County,
California, being Lots 1-16 inclusive of the Lancer Hills Subdivision, Unit 4, as
shown on the Map recorded April 7, 1997, in Book 21 of Maps at page 98,
Shasta County Records (previously A.P.N. 071-370-19).
(c) The City Council hereby orders the annexation of said additional territory into
Area 10 of Landscape Maintenance District "A" for the maintenance of
landscaping, miscellaneous lighting, mulching, vandalism, repairs to the
irrigation system, electric and water charges, replacement of vegetation as
necessary, and any and all incidental expenses, including administrative costs,
in connection therewith, all as more particularly authorized pursuant to the
Landscaping and Lighting Act of 1972.
3. The assessment diagram contained in the Engineer's Report is confirmed.
4. The City Council has considered all oral statements and written protests or
communications made or filed by interested persons at the public meeting of May 6,
1997, and the public hearing of May 20, 1997, and expressly overrules any and all
protests filed objecting to the proposed assessments to be levied in the District.
5. The City Council finds that the Engineer has fairly and properly apportioned the cost
of the improvements to each lot/remaining parcel of land in the District (including the
above area annexed into Area 10) in proportion to the estimated benefits to be received
by each lot/remaining parcel from the improvements.
6. An assessment of $29.46 against each lot and remaining parcel located within the
District for fiscal year 1997/98 is adopted and confirmed, except that an assessment
shall not be levied on property owned by a federal or state governmental agency or
another local agency.
7. Resolution No. 97-90 adopted May 20, 1997, is hereby rescinded and shall have no
force or effect.

8. The City Clerk shall forthwith transfer to the Auditor and the Assessor/Recorder of
Shasta County a certified copy of this resolution and a certified copy of the assessment
diagram contained in the Engineer's Report.
I HEREBY CERTIFY that the foregoing resolution was introduced, read and adopted
at a regular meeting of the City Council on the 19th day of August, 1997, by the following
vote:
