RESOLUTION NO. 97- /93 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDDING SUMMARILY VACATING A PORTION OF THE RAILROAD AVENUE RIGHT-OF-WAY LOCATED ADJACENT TO STATE ROUTE 273 AND NORTH OF B�JENAVENTURA BOULEVARD. WHEREAS, the State of California relinquished its ownership of Railroad Avenue to the County of Shasta, and the City of Redding acquired Railroad Avenue from the County through annexation; and WHEREAS, the recent realignment of Railroad Avenue north of Buenaventura Boulevard has resulted in a portion of Railroad Avenue becoming excess right-of-way that is no longer required for roadway purposes; and WHEREAS, it is the recommendation of staff that the City summarily vacate the excess Railroad Avenue right-of-way ("Area of Abandonment") for roadway purposes only, reserving and excepting an easement and right in favor of the City of Redding to maintain, operate, replace, remove, or renew the public facilities over, along, through and under the entire Area of Abandonment; the Area of Abandonment is described in Exhibits A and B and shown crosshatched on Exhibits A1 and Bl attached hereto and made a part hereof; NOW, THEREFORE, THE CITY COUNCIL DETERMINES, RESOLVES AND ORDERS AS FOLLOWS: �::,,:::,.j-�c::;�S��fAGEt��tJ�: i._�.1 �".r..� .. .....r.;... � • • 1. The City Council elects to proceed in this matter under the provisions of the Public Streets, Highways and Service Easements Vacation Law as set forth in Section 8330, et seq., of the Streets and Highways Code of the State of California. 2. The recent realignment of Railroad Avenue north of Buenaventura Boulevard has resulted in a portion of Railroad Avenue (Area of Abandonment) becoming excess right-of-way that is no longer required for roadway purposes. 3. The City Council approves the request to summarily vacate the Area of Abandonment described in Exhibits A and B and shown crosshatched on Exhibits A1 and B1, SUBJECT TO reserving and excepting from the vacation an easement and right in favor of the City of Redding to maintain, operate, replace, remove, or renew the public facilities over, along, through and under the entire Area of Abandonment. 4. The City Clerk is directed to cause a certffied copy of this resolution of vacation, attested by the Clerk under seal, to be recorded in the office of the Shasta County Assessor/Recorder. 5. From and after the date this resolution is recorded, the Area of Abandonment shall no longer constitute a portion of Railroad Avenue.
