HomeMy WebLinkAboutReso 97-219 - Approve the report and Findings of the Board of Appeals & Ordering the Abatement of the Unsafe & Unsightly Bldgs on Property Located at 1029 View Ave Owned by Emily & Brian Brady . � e � RESOLUTION 97- 2f y A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDDING ANPROVING THE REPORT AND FINDINGS OF THE BOARD OF APPEALS AND ORDERING THE ABATEMENT OF THE UNSAFE AND UNSIGHTLY BUILDINGS ON PROPERTY AT 1029 VIEW AVENUE, OWNED BY EMILY AND BRIAN BRADY. WHEREAS, on October 7, 1997 the City Council adopted Resolution 97-173, a Resolution of intention to begin abaten�ent proceedings under the provisions of Chapter 9.36 of the Redding Municipal Code, affecting property owned by Emily and Brian Brady at 1029 View Avenue, in tl�e City of Redding, being Assessor's Parcel 107-240-08, and mare particularly described in said Resolution 97-173; and WHEREAS, a Notice of Hearing by the Board of Appeals on this abatement proceeding has been posted on the subject property and mailed to the ow�lers of record at their preseilt address; and WHEREAS,a public heai•ing was held on November 25, 1997, before said Board of Appeals as provided in said Municipal Code and testimony was received by the Board; and WHEREAS, at its meeting of November 25, 1997, said Board of Appeals, having heard testiillo�ry fro�n the City Building Inspector that the required work had not take�l place, found that good and sufficient cause does not exist why the unsafe and unsightly buildings on said property should not be abated; and WHEREAS, said Board of Appeals has filed with this City Council its Report of the hearing and its reconlmendation for abatement by repair or demolition; NOW, THEREFORE, IT IS HEREBY RESOLVED by the City Council of the City of Redding as follows: 1. That the Report of the Board of Appeals of its findings that the unsafe and unsightly buildings existing on the property at 1029 View Avenue should be either repaired or demolished and removed is hereby approved. y\, v 2. That the Fire Marsl�al of the City of Redding is hereby directed to abate said unsafe � and ui�sightly conditions aftec a period of thirty (30) days from the date hereof, by having the unsafe � and unsightly buildings demolished and removed; and that he and his authorized representatives are � ` V hereby expressly authorized to enter upon the subject property foi-that purpose, and are directed to � � ::��:_::•t�.::i ... ...'�...E .L �` °...� ... � ... ....,....,,:x�:::r . � � .: . � , : •� +_.��... . � . . . , 4� � � � • keep an iteinized account of the costs of abating said nuisance,which costs are to be assessed against the property if not paid by the owners. 3. Tl�at a copy of this Resolution shall be served upon the property owners in accardance with the provisions of Section 9.36.060 of Chapter 9.36 of the Municipal Code; and the property owners shall have the right to have such unsafe and unsightly buildings abated at their own expense, providing the same is done prior to the expiration of the 30-day period set forth in paragraph 2 above.
