A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
REDDING ORDERING THE ABANDONIVIENT OF PORTIONS
OF AN OPEN SPACE �ASEMENT WITH�T �H� FAIRWA�S
OF THE GOLD I3ILLS COUNTRY CL�JB (A-10-97).
WHEREAS, on January 6, 1998, by Resolution 98-2, the City Council adopted a resolution
of intention to abandon the hereinafter described portions of an open space easement (hereinafter
referred to as "Area of Abandonment"); and
WHEREAS, proceedings have been duly conducted and held in accordance with the
provisions of California Government Code Section 51090, et seq.; and
WHEREAS, this abandonment is subject to the condition that prior to the recording of this
abandonment in the office of the Shasta County Recorder, the following are to occur:
(a) A greater area of open space easement for the future Gold Hills Golf Course 15th
fairway ("Proposed Easement") is to be dedicated to the City of Redding, improved,
and opened for play prior; and
(b) The abandonment fee, if any, that the property owner must pay to the County
Treasurer has been paid in full; and
WHEREAS, when the above conditions have been met, the Area of Abandonment will not
be needed for public use;
NOW, THEREFORE, the City Council FINDS, RESOLVES and ORDERS as follows:
1. The above recitals are true and correct.
2. The Area of Abandonment is described in Exhibit A and shown on the map attached hereto �
and made a part hereof.

3. The City Council makes the following findings in connection herewith: �
(a) No public purpose described in Government Code Section 51084 will be served by ;
keeping the land as open space; �

(b) The abandonment is not inconsistent with the purposes of Article 4, Termination of an
Open-space Easement, of California Government Code Section 51090, et seq.;
(c) The abandonment is consistent with the Redding General Plan; and
(d) The abandonment is necessary to avoid a substantial financial hardship to the
landowner due to involuntary factors unique to him.
4. All requirements of California Government Code Section 51090, et seq., have been complied
with.
5. On the basis of the initial study for abandonment application A-10-97 prepared by the
Development Services Department, the City Council finds that the subject abandonment will
not have a significant effect on the environment and approves the negative declaration with
the following findings:
(a) The project is compatible with the Redding General Plan, the surrounding land use
and the Code of the City of Redding, California; and
(b) The project will not significantly alter existing land form.
6. That certain open space easement dedicated to the City of Redding as set forth in paragraph 2
hereof be and the same is hereby abandoned, SUBJECT TO TI3E CONDITION that this
abandonment shall not become effective nor shall this resolution be recorded until the
following have occurred:
(a) A greater area of open space easement for the future Gold Hills Golf Course 15th
fairway ("Proposed Easement") is to be dedicated to the City of Redding, improved,
and opened for play prior; and
(b) The abandonment fee, if any, that the property owner must pay to the County
Treasurer has been paid in full.
7. When the Director of Development Services advises the City Clerk that the above conditions
have been met, the City Clerk is directed to record a certified copy of this resolution, attested
by the Clerk under seal, in the office of the Shasta County Assessor/Recorder.

All that certain real property situate in Section 17, Township 32 North, Range 4 West, NIDM, in
the City of Redding, County of Shasta, State of California, described as follows:
Those portions of Parcel 4A, as shown on Pazcel Map No. LS 22-88, filed for record in the
office of the County Recorder Apri128, 1988 in Book 26 of Pazcel Maps at page 137, Shasta
County Records, more particularly described as follows:
PARCEL 1:
BEGINNING at the most southerly point of Lot 20 as shown on the map of Gold Hills
Subdivision, Unit 4, No. S-5-88, said point being marked by a 5/8" rebar with aluminum cap
marked RCE 14359; thence along the southeasterly line of said Lot 20, North 68°49'23" East a
distance of 34.24 feet to a point marked by a 5/8" rebar with aluminum cap marked RCE 14359;
thence leaving said Lot 20, c�ntinuing North 68°49'23" East and along the boundary linP of said
