A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDDING
CONSENTING TO THE APPROVAL OF AN OPTION AND PURCHASE AND SALE
AGREEMENT BY AND BETWEEN THE REDDING REDEVELOPMENT AGENCY
AND
EDDIE L. TROOP AND LINDA MCMAHAN AND MAHING CERTAIN FINDINGS IN
CONNECTION HEREWITH
WHEREAS,the Redding Redevelopment Agency is engaged in activities necessary to
execute and implement the Redevelopment Plan for the Market Street Redevelopment Project
Area; and
WHEREAS, in furtherance of the objectives of the California Community
Redevelopment Law (California Health and Safety Code Section 33000 et seq.), the Agency has
undertaken a project to realign Westside Road; and
WHEREAS, the Implementation Plan adopted by the Agency with respect to the
Redevelopment Plan includes the realignment of both Railroad Avenue and Westside Road as
means to improve inadequate public infrastructure, allow utilization of previously undeveloped
or undercleveloped land, act as an incentive to private development to invest in the area, and to
alleviate traffic congestion within the Project Area; and
WHEREAS, the realignment of Westside Road will necessitate the acquisition of land
located at 4220 Westside Road and the displacement of the Redding Veterinary Clinic at that
location; and
WHEREAS, the Agency owns surplus property at 4060 Railroad Avenue consisting of
former street right of way and a remnant acquired as a byproduct of the Railroad Avenue
realignment; and
WHEREAS, the Agency and Eddie L. Troop and Linda McMahan propose to enter into
a Purchase and Sale and Settlement Agreement pursuant to which the Agency would acquire the
Redding Veterinary Clinic; and
WHEREAS, as a part of said agreement, the Agency and Eddie L. Troop and Linda
McMahan propose to enter into an Option and Purchase and Sale Agreement for surplus
property located at 4060 Railroad Avenue as a replacement site for the veterinary clinic; and
WHEREAS, pursuant to Section 33433 of the Community Redevelopment Law, the
Agency is authorized, with the majority approval of the City Council after public hearing, to
convey property for redevelopment purposes pursuant to the Redevelopment Plan upon a
determination by the City Council that the sale of the property will assist in the elimination of
blight and that the consideration for such sale is not less than either fair market value or fair
reuse value in accordance with the covenants and conditions governing the sale and development \
costs thereof; and . ''��
WHEREAS, a joint public hearing of the Agency and City Council on the proposed
Option and Purchase and Sale Agreement was duly noticed in accordance with the requirements ��
of Health and Safety Code Section 33433; and �
WHEREAS, the proposed Agreement and a summary report meeting the requirements �
of Health and Safety Code Section 33433 were available for public inspection consistent with �
the requirements of Health and Safety Code Section 33433; and

WHEREAS, on 7anuary 6, 1998, the Agency and City Council held a joint public
hearing on the proposed Agreement and evaluated all of the information, testimony, and
evidence presented during the joint public hearing; and
WHEREAS, the City Council has reviewed the summary report required pursuant to
Health and Safety Code Section 33433 and evaluated other information provided to it pertaining
to the findings required pursuant to Section 33433; and
WHEREAS, the sale of the property pursuant to the proposed Agreement will improve
the quality of life of the residents of the City of Redding by the elimination of blight by
providing for the reuse and redevelopment of a portion of the Project Area which formerly
contained deteriorated, obsolete structures; and
WHEREAS, the value of the consideration for the property pursuant to the proposed
Agreement will be equal to the fair reuse value of the site as set forth in the Summary Report;
and
WHEREAS, the City Council has duly considered all terms and conditions of the
proposed Agreement and believes that the disposition of the Site pursuant thereto is in the best
interests of the City of Redding and the health, safety, and welfare of its residents, and in accord
with the public purposes and provisions of applicable state and local laws and requirements.
NOW, THEREFORE,the City Councit FINDS, RESOLVES AND ORDERS as
foilows:
1. The above recitals are true and correct.
2. The City Council makes the following findings in connection with the proposed Option
and Purchase and Sale Agreement:
(a) The sale of the property at 4060 Railroad Avenue will assist in the elimination of
blight and is consistent with the implementation plan adopted pursuant to Section
33490 of the California Health and Safety Code; and
(b) The consideration is not less than the fair reuse value at the use and with the
covenants and conditions and development costs authorized by the sale.
3. The City Council hereby consents to the execution of the Agreement by the Agency
subject to environmental review and a determination by the Redding Planning
Commission that the disposition would be consistent with the Redding General Plan. A
copy of the Agreement when executed shall be placed on file in the office of the City
Clerk.

I HEREBY CERTIFY that the foregoing resolution was introduced, read and adopted
by a majority vote at a regular meeting of the City Council on the 6th day of Januarv, 199s.
