RESOLUTION NO. 98-� A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDDING ORDERING THE VACATION OF THAT PORTION OF THE CANYON CREEK ROAD RIGHT-OF-WAY SOUTH OF ITS INTERSECTION WITH BUENAVENTURA BOULEVARD (A-8-97). WHEREAS: A. On February 17, 1998, by Resolution 98-18, the City Council adopted a resolution of intention to abandon the hereinafter-described Area of Abandonment. B. Proceedings have been duly conducted and held in accordance with the provisions of the Public Streets, Highways and Service Easements Vacation Law as set forth in Section 8300, et seq. of the Streets and Highways Code of the State of California. C. This abandonment is subject to the condition that prior to the recording of this resolution in the office of the Shasta County Assessor/Recorder, the following are to occur: (1) The completion of the Westside Road realignment between Buenaventura Boulevard and Westside Road; and (2) A public service easement is to be retained over the entire Area of Abandonment. D. When the above conditions have been met, the Area of Abandonment will be unnecessary for present or prospective public use. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF REDDING FINDS, RESOLVES AND ORDERS AS FOLLOWS: 1 The above recitals are true and correct � 1 2. The Area of Abandonment is that portion of the Canyon Creek Road right-of-way south of its � intersection with Buenaventura Boulevard, in the City of Redding, County of Shasta, State of California, as more particularly described in Exhibit A and shown crosshatched on the map attached � hereto and made a part hereof. � . • • . 3. On the basis of the initial study prepared by the Development Services Department, the City Council finds that the subject vacation will not have a significant effect upon the environment and approves the negative declaration with the following �ndings: (a) The project is compatible with the Redding General Plan, the surrounding land use, and the Redding Municipal Code; and (b) The project will not signi�cantly alter the existing land form. 4. All requirements of California Streets and Highways Code Section 8300, et seq., have been complied with. 5. Public convenience and necessity require the retention of a public service easement over the entire Area of Abandonment. Subject to the reservation of a public service easement, when the Westside Road realignment between Buenaventura Boulevard and Westside Road is completed, the Area of Abandonment will be unnecessary for present or prospective public use. 6. The Area of Abandonment is hereby vacated, SUBJECT TO: (1) The retention of a public service easement over the entire Area of Abandonment; and (2) This vacation shall not become effective nor shall this resolution be recorded until the completion of the Westside Road realignment between Buenaventura Boulevard and Westside Road. 7. When the Director of Development Services advises the City Clerk that the above conditions have been met, the City Clerk is directed to record a certified copy of this resolution, attested by the Clerk under seal, in the office of the Shasta County Assessor/Recorder.
