RESOL�TTION NO. 98-�
LANDSCAPE MAINTENANCE DISTRICT "B"
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
REDDING:
(1) ORDERING THE ANNEXATION OF UNIT 2 OF THE
MONTEREY SPRINGS 5UBDIVISION INTO AREA 8 OF THE
DISTRICT;
(2) CONFIRMING THE ASSESSMENT DIAGRAM; AND
(3) ORDERING THE LEVY OF THE ANNUAL ASSESSMENTS FOR
FISCAL YEAR 1998/99 PURSUANT TO THE LANDSCAPING
AND LIGHTING ACT OF 1972 (COMI��NCING WITH SEC�ION
22500 OF 'I'HE STREETS AND HIGHWAYS CODE).
WHEREAS, on May 5, 1998, by Resolution 98-49, the City Council approved the
Rep��rt of the Engineer as filed relating to Landscape Maintenance District "B" (District), and
gavf; notice of the time and place of the July 7, 1998, public hearing regarding the levy and
collf;ction of assessments for fiscal year 1998/99; and
WHEREAS, the City Council, by Resolution 98-50, also gave notice of its intention to
annf;x additional territory—Unit 2 of the Monterey Springs Subdivision—into Area 8 of the
District, and gave notice of the time and place of the public meeting on June 2, 1998, to
address the proposed annexation, and the public hearing on July 7, 1998, to address the levy
and collection of assessments for fiscal year 1998/99; and
WHEREAS, a diagram of the area encompassed by the District, including the area
pro�►osed to be annexed in, individual maps, and a summary are attached and made a part
hereof; and
WHEREAS, the public hearing, duly and properly noticed, commenced at the City
Council Chambers, 1313 California Street, Redding, California, on July 7, 1998, and was
concluded prior to the adoption of this resolution; and
WHEREAS, at the July 7 public hearing, the City Council gave every interested
person an opportunity to object to the proposed assessments; and �
WHEREAS, all legal prerequisites to the adoption of this resolution have occurred, C�
including the public meeting held June 2, 1998; �

NOW, THEREFORE, THE CITY COUNCIL FINDS, RESOLVES,
DETERMINES AND ORDERS AS �OLLOWS:
l. The matters set forth above are true and correct.
2. With respect to the additional territory proposed to be annexed into Landscape
Maintenance District "B":
(a) This area was formerly in Landscape Maintenance District "C" (a holding
district) until the developer fulfilled his obligation to install the landscaping and
maintain it during the maintenance period.
(b) Said territory is described as follows:
All of that certain real property situate in the City of Redding, Shasta County,
California, being Lots 1-49 inclusive of the Monterey Springs Subdivision,
Unit 2, as shown on the Map recorded October 12, 1993, in Book 21 of Maps
at page 39, Shasta County Records (AP numbers 117-480-01 through 30, and
117-490-1 through 19).
(c) The City Council hereby orders the annexation of said additional territory into
Area 8 of Landscape Maintenance District "B" for the maintenance of
landscaping, removal of debris, miscellaneous lighting, mulching, vandalism,
repairs to the irrigation system, electric and water charges, replacement of
vegetation as necessary, and any and all incidental expenses, including
administrative costs, in connection therewith, all as more particularly authorized
pursuant to the Landscaping and Lighting Act of 1972.
3. The assessment diagram contained in the Engineer's Report is confirmed.
4. The City Council has considered all oral statements and written protests or
communications made or filed by interested persons at the public meeting of June 2,
1998, and the public hearing of July 7, 1998, and expressly overrules any and all
protests filed objecting to the proposed assessments to be levied in the District.
5. The City Council finds that the Engineer has fairly and properly apportioned the cost
of the improvements to each lot/remaining parcel of land in the District (including the
above area annexed in as Area 8) in proportion to the estimated benefits to be received
by each lot/remaining parcel from the improvements.
6. An assessment of $71.00 against each lot and remaining parcel located within the
District for fiscal year 1998/99 is adopted and confirmed, except that an assessment
shall not be levied on property owned by a federal or state governmental agency or
another local agency.

7. The City Clerk shall forthwith transfer to the Auditor and the Assessor/Recorder of
Shasta County a certified copy of this resolution and a certified copy of the assessment
diagram contained in the Engineer's Report.
I HEREBY CERTIFY that the foregoing resolution was introduced, read and adopted
at a regular meeting of the City Council on the 7th day of July, 1998, by the following vote:
