LANDSCAPE MAINTENANCE DISTRICT "A"
A RESOLUTION OF THE CITY COUNCII. OF THE CITY OF
REDDING:
(1) ORDERING THE ANNEXATION OF iJNIT 2 OF THE WHITE
HAWK ESTATES SUBDIVISION INTO AREA 17 OF THE
DISTRICT;
(2) CONFIRMING THE ASSESSMENT DIAGRAM; AND
(3) ORDERING THE d,EVY OF THE ANNUAL ASSESSMENTS
FOit FISCAL YEAI� 1998/99 PURSUANT TO THE
LANDSCAPING AND LIGHTING ACT OF 1972
(COMMENCING WITH SECTION 22500 OF THE STREETS
AND HIGHWAYS CODE).
WHEREAS, on May 5, 1998, by Resolution 98-48, the City Council approved the
Report of the Engineer as filed relating to Landscape Maintenance District "A" (District),
and gave notice of the time and place of the July 7, 1998, public hearing regarding the
proposed annexation and the levy and collection of assessments for fiscal year 1998/99; and
WHEREAS, a diagram of the area encompassed by the District, including the area
proposed to be annexed in, individual maps, and a summary are attached and made a part
hereof; and
WHEREAS, the public hearing, duly and properly noticed, commenced at the City
Council Chambers, 1313 California Street, Redding, California, on July 7, 1998, and was
concluded prior to the adoption of this resolution; and
WHEREAS, at the July 7 public hearing, the City Council gave every interested
person an opportunity to object to the proposed assessments; and
WHEREAS, all legal prerequisites to the adoption of this resolution have occurred;
NOW, THEREFORE, THE CITY COUNCIL FINDS, RESOLVES, �
DETERMIlVES AND ORDERS AS FOLLOWS: ,

1. The matters set forth above are true and correct. �

2. With respect to the additional territory proposed to be annexed into Landscape
Maintenance District "A":
(a) The owners of the land within the boundaries of the additional territory
proposed to be annexed into the District have filed their Petition and Consent
to said inclusion; and have waived the resolutions, engineer's report, notices
of hearing, and the right of a majority protest with regard to the area
proposed to be annexed as provided by Section 22608 of the Streets and
Highways Code.
(b) Said territory is described as follows:
All of that certain real property situate in the City of Redding, Shasta
County, California, being Lots 1-28 inclusive of the White Hawk Estates
Subdivision, Unit 2, as shown on the Map recorded December 19, 1997, in
Book 22 of Maps at page 15, Shasta County Records (APN 104-260-1
through 16, and 104-910-13 through 24).
(c) The City Council hereby orders the annexation of said additional territory
into Area 17 of Landscape Maintenance District "A" for the maintenance of
landscaping, removal of debris, miscellaneous lighting, mulching,
vandalism, repairs to the irrigation system, electric and water charges,
replacement of vegetation as necessary, and any and all incidental expenses,
including administrative costs, in connection therewith, all as more
particularly authorized pursuant to the Landscaping and Lighting Act of
1972.
3. The assessment diagram contained in the Engineer's Report is confirmed.
4. The City Council has considered all oral statements and written protests or
communications made or filed by interested persons at the public hearing of July 7,
1998, and expressly overrules any and all protests filed objecting to the proposed
assessments to be levied in the District.
5. The City Council finds that the Engineer has fairly and properly apportioned the
cost of the improvements to each lot/remaining parcel of land in the District
(including the above area annexed into Area 17) in proportion to the estimated
benefits to be received by each lot/remaining parcel from the improvements.
6. An assessment of $29.46 against each lot and remaining parcel located within the
District for fiscal year 1998/99 is adopted and confirmed, except that an assessment
shall not be levied on property owned by a federal or state governmental agency or
another local agency.
7. The City Clerk shall forthwith transfer to the Auditor and the Assessor/Recorder of
Shasta County a certified copy of this resolution and a certified copy of the

assessment diagram contained in the Engineer's Report for Landscape Maintenance
District "A."
I HEREBY CERTIFY that the foregoing resolution was introduced, read and
adopted at a regular meeting of the City Council on the 7th day of July, 1998, by the
