Code §6103 A.P.N. 107-220-28, 39 ItESOL�JTION NO. 98-� A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDDING SUMMARILY VACATING A PORTION OF TWO EASEMENTS FOR SEWER P�JRPOSES GRANTED TO THE CITY OF REDDING ON PROPERTY LOCATEI) AT 980 EAS� CYPRESS AVENUE (A-6-98). WHEREAS: 1. A permanent easement and right-of-way for sewer purposes, including underground sewer pipes, manholes and rodholes, was granted to the City of Redding by Howard B. Nelson and Mildred Nelson on December 8, 1960. The "Easement for Certain Purposes" was recorded August 18, 1961, in Book 677 of Official Records at page 644, Shasta County Records. 2. A permanent easement and right-of-way for sewer purposes, including underground sewer pipe, manholes and rodholes, was granted to the City of Redding by M. Phil Moore and Mary J. Moore on August 15, 1961. The "Easement for Certain Purposes" was recorded August 31, 1961, in Book 679 of Official Records at page 436, Shasta County Records. 2. The aforesaid easements are collectively referred to herein as "the Easements." 3. The sewer line located within the cross-hatched portion of the Easements—the "Area of Abandonment" as more particularly described in Exhibit A and shown on Exhibit B attached hereto and made a part hereof—has been relocated. 4. Easement Grant Deeds for the new sewer-line location have been granted to the City of Redding and are in the process of being recorded. 5. The property owner has requested the abandonment of the Area of Abandonment due to its relocation. 6. The Public Works Department has advised the City Council that, with the relocation of the sewer line, there are no in-place public utility facilities that are in use or would be affected by vacating the cross-hatched portion of the Easements. -r� :��O�PdGE��� /,�' ` .-�-��-a�;�- � VJ.• � • ' � �. � � NOW, TgIEREFORE, THE CITY COUNCIL RESOLVES AND ORDERS AS FOLLOWS: 1. The City Council elects to proceed in this matter under the provisions of the Public Streets, Highways and Service Easements Vacation Law as set forth in Section 8330, et seq., of the Streets and Highways Code of the State of California. 2. The cross-hatched portion of the Easements is no longer needed for sewer purposes due to relocation; and there are no public facilities located therein. 3. The City Council approves the request to summarily vacate the cross-hatched portion of the Easements as more particularly described in Exhibit A and shown crosshatched on Exhibit B attached hereto, SUBJECT TO all of the Easement Grant Deeds in favor of the City of Redding for the new sewer-line location being recorded before this resolution is recorded. 4. When the Director of Public Works has advised the City Clerk that all of the Easement Grant Deeds for the new sewer-line location have been recorded, the City Clerk is directed to cause a certified copy of this resolution of vacation, attested by the Clerk under seal, to be recorded in the office of the Shasta County Assessor/Recorder. 5. From and after the date this resolution is recorded, the cross-hatched portion of the Easements hereby vacated shall no longer constitute permanent easements and rights-of-way for sewer purposes.
