WHEREAS, City of Redding City Council by Resolution No. 95-]35 has approved the signing of Contract No. 94-SAO-00047 (Contract) between the Central Va11ey Project (CVP) Customers , the Western Area Power Administration(Western) and the United States Bureau of Reclamation (USBR) for the funding of maintenance work at Shasta Powerplant for $21,175,000, wherein Redding is a ten percent funding participant; WHEREAS, Western and the USBR, under Amendment No. 1 to Contract No. 94-SAO-00047, are amending the scope of the Contract for additional maintenance work on Shasta Units 3, 4, and S, to include the purchase and installation of new turbine runners, wherein the funding limit for the contract will not change; WHEREAS, Western will provide additional excess firm capacity to the Contract Customers, including Redding, when such excess capacity is made available to Western by the USBR upon completion of the maintenance and upgrades starting with Shasta Unit No. 3; WHEREAS, under Letter of Agreement 98-SNR-00048, the USBR and Western are providing CVP Customers, including the City of Redding, with the option to delay the scheduled maintenance work on Shasta Unit No. 5 for three summer months starting with July, 1998, and purchase additional � � � � � ,, ' ' ' ' � � summer finn capacity for an up-front payment of$250,000, wherein Redding's cost allocation would be approximately $29,000. The additional purchase price of the associated energy would be at the CVP commercial energy rate of$16.35 per megawatt-hour. NOW, THEREFORE, IT IS HEREBY RESOLVED that the City Council of the City of Redding deems it is in the best interest of the City's Electric Utility customers that the attached Contract Amendment No. 1 and LOA be signed by the Mayor when presented in final form by Western and the USBR and authorizes payment to the USBR of an amount not to exceed $38,000 for such additiona� seasonal surplus capacity. EXPLANATORY RECITALS: 7 2.1 Western, Reclamation, and the Customers entered into Contract No. 94-SAO- 8 00047 (Primary Contract) for funding of maintenance work at Shasta Powerplant. 9 10 2.2 The Parties desire to add additional work to the Primary Contract to replace the 11 turbine runners on generating units 3, 4, and 5 at Shasta Dam and Powerplant. 12 13 2.3 Replacement of the turbine nuuiers is expected to increase the ultimate hydraulic 14 capacity of Shasta Powerplant by an additiona151 megawatts(MV� over and above the 15 47 MW increase set forth in Section 9 of ttie Primary Contract. 16 17 2.4 The replacement of the turbine nuuiers is not expected to increase the funding 18 amount required above the original estimate of twenty-one million, one hundred seventy- 19 five thousand dollars($21,175,000.00)the Customers agreed to pay under the Primary 20 Contract. 21 22 2.5 This Contract Amendment revises Section 6 of the Primary Contract to include 23 work associated with replacement of the turbine runners and revises Section 9 to increase 24 the amount of excess capacity from 47 MW to 98 MW. Exhibit A (Estimated Funding 25 and Project Work Schedule) and Exhibit C (Shasta Rewind Incremental Increase in 26 Capacity) of the Primary Contract will also be revised as a result of this Contract 27 Amendment. 28 2 . , . . � • 1 2.6 The Parties expect that upon completion of the Unit rewind work, any resulting 2 excess capacity will be made available to the Customers pursuant to the terms of the 3 Primary Contract. Upon completion of the installation of each turbine nuiner, any . 4 resulting excess capacity will be made available to the Customers as set forth in this 5 Amendment. 6 7 3. AGREEMENT: The Parties agree to the tertns and conditions set forth herein. 8 9 4. EFFECTIVE DATE AND TERM OF CONTRACT AMENDMENT: This 10 Contract Amendment shall become effective upon execution by all the Parties and remain in 11 effect concurrently with the Primary Contract. 12 13 5. PRIMARY CONTRACT TO REMAIN IN FULL FORCE AND EFFECT: Except 14 as expressly modified by this Contract Amendment, said Primary Contract shall remain in full 15 force and effect, and this Contract Amendment shall be subject to all provisions of the Primary 16 Contract. 17 18 6. MODIFICATION OF SECTION 9 OF THE PRIMARY CONTRACT: 2 The first paragraph in Section 9 of the Primary Contract is hereby deleted and the following 3 substituted therefor: � 4 "9. RIGHT TO EXCESS CAPACITY: 5 Reclamation has determined that rewinding and increasing the nameplate ratings of 6 Shasta units 3, 4, and 5 up to 125 MW each is expected to result in a total increase of 7 approximately 47 MW in the capacity available at Shasta Powerplant when the storage 8 in Shasta Lake exceeds 3.6 million acre feet (MAF). As requested by the Customers, 9 Reclamation will increase the generator nameplate ratings of each of these units to 142 10 MW, as part of the work generally described in Section 6.2.3 and 6.2.4 hereof. The 11 additional electrical capacity above 125 MW is expected to be utilized when the turbine 12 runners are replaced as set forth in Section 6.2.6. With the replacement of each 13 turbine runner, the full 142 MW of nameplate rating of each unit will be available 14 depending upon hydraulic conditions. Western 19 shall use this information to update Exhibit C attached hereto which shows the 20 incremental increase in Shasta capacity at certain Shasta Lake water storage and 21 reservoir elevations.
