A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
REDDING SUMMARILY VACATING A PORTION OF A 30' WIDE
EASEMENT FOR STREET AND UTILITY PURPOSES DEEDED BY
JAMES B. AND KAREN MATHEWSON TO THE CITY OF REDDING
ON MARCH 6, 1980, AND RECORDED IN BOOK 1795 OF OFFICIAL
RECORDS AT PAGE 348, SHASTA COUNTY RECORDS.
WHEREAS, a 30' wide easement for street and utility purposes was deeded to the City
of Redding by James B. Mathewson and Karen Mathewson on March 6, 1980, and recorded
March 6, 1981, in Book 1795 of Official Records at page 348, Shasta County Records
("Easement"), as more particularly described in a copy of the Grant Deed attached hereto and
made a part hereof; and
WHEREAS, except for the easterly 15.00' of the easterly 30.00' of the Easement (the
double crosshatched area) which is being retained by the City for street and utility purposes,
the property owner has requested that the remainder of the Easement be vacated due to its non-
use; and
WHEREAS, the proposed area of vacation is located at 2990 Forest Hills Drive
(mailing address: 3400 Goodwater Avenue) and described in Exhibit A and shown
crosshatched on Exhibit B attached hereto and made a part hereof by reference; and
WHEREAS, the Public Works Department has advised the City Council that with
regard to the proposed area of vacation, (1) it has never been used for street purposes; (2) �
there are no public utility facilities that are in use; and (3) there is no indication it will be �j
required for prospective street or utility purposes; '

NOW, THEREFORE, THE CITY COUNCIL FINDS, RESOLVES and ORDERS
AS FOLLOWS:
1. The City Council elects to proceed in this matter under the provisions of the Public
Streets, Highways and Service Easements Vacation Law as set forth in Section 8330, et
seq., of the Streets and Highways Code of the State of California.
2. The proposed area of vacation has not been used for the purposes for which it was
acquired for five consecutive years immediately preceding the proposed vacation.
3. The City Council approves the request to summarily vacate the portion of the Easement
described in Exhibit A and shown crosshatched on Exhibit B attached hereto.
4. The City Clerk is directed to cause a certified copy of this resolution of vacation,
attested by the Clerk under seal, to be recorded in the office of the Shasta County
Assessor/Recorder.
5. From and after the date this resolution is recorded, the portion of the Easement hereby
vacated shall no longer constitute an easement for street and utility purposes.
I HEREBY CERTIFY that the foregoing resolution was introduced, read and adopted
at a regular meeting of the City Council on the 18th day of August , 1998, by the
