BEC�RWN6 F�S�.-- RESOLUTION NO. 98- �� A RESOLUTION OF THE CITY COUNCII, OF THE CITY OF REDDING ORDERING THE VACATION OF PORTIONS OF THAT SEGMENT OF THE CANBY ROAD RIGHT-OF-WAY LOCATED NOR�H OF DANA DRIVE AND EAST OF THE MT. SHASTA MALL (A-7-91). WHEREAS: A. On July 7, 1998, by Resolution 98-103, the City Council adopted a resolution of intention to abandon the hereinafter-described Areas of Abandonment. B. Proceedings have been duly conducted and held in accordance with the provisions of the Public Streets, Highways and Service Easements Vacation Law as set forth in Section 8300, et seq. of the Streets and Highways Code of the State of California. C. This abandonment is SUBJECT TO the retention of a public service easement for all existing utilities AND whatever other conditions the City Council may deem appropriate. Thereafter, the Areas of Abandonment will be unnecessary for present or prospective public use, and this resolution may be recorded in the office of the Shasta County Assessor/Recorder. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF REDDING FINDS, RESOLVES AND ORDERS A5 FOLLOWS: 1 Each of the above recitals is true and correct 2. The Areas of Abandonment are those portions of the Canby Road right-of-way located north of Dana Drive and east of the Mt.Shasta Mall, as described in Exhibit A and shown crosshatched on the map attached hereto and made a part hereof. j��j'C��`�-C��C.�G/ B�✓ ��`�-�-a c� c� � c��.�J�J1.PAGE496 , • � . • 3. On the basis of the initial study prepared by the Development Services Department, the City Council finds that: (a) There is no substantial evidence in light of the whole record before the City Council that the project will have a significant adverse impact upon the environment; and (b) The project is consistent with the objectives, policies and standards of the City of Redding general plan and zoning ordinance. 4. All requirements of California Streets and Highways Code Section 8300, et seq., have been complied with. 5. Public convenience and necessity require the retention of a public service easement for all existing utilities. Subject to the reservation of this public service easement, and whatever other conditions the City Council may adopt—to be included in this resolution, the Areas of Abandonment will be unnecessary for present or prospective public use and are hereby vacated.
