A RESOLUTION OF THE CITY COUNCII.. OF THE CITY OF REDDING
SUMMARILY VACATING AN EASEMENT OFFERED FOR DEDICATION,
BUT NEVER ACCEPTED BY THE CITY, GRANTED BY WII,LIAlV1 L. AND
JANET 1!✓I. GILLILAND, TRUSTEES, ON DECEMBER 17, 1994.
WHEREAS, an Offer of Dedication dated December 17, 1994, by William L. and Janet M.
Gilliland, i rustees, in favor of the City of Redding for public use for any public purpose (open
space, floodplain purposes and trail) was recorded on December 21, 1994, under No. 52058, in
Book 3239 of Official Records at page 686, Shasta County Records (hereafter referred to as
"proposed easement"); and
WHEREAS, pursuant to Government Code Section 7050, the offer of dedication shall be
irrevocable and may be accepted at any time by the City Council; it may also be terminated and the
right to accept such offer abandoned by the City Council in the same manner as is prescribed for the
summary vacation of streets or highways by Part 3 (commencing with Section 8300) of Division 9 of
the Streets and Highways Code;
NOW, THEREFORE, THE CITY COUNCIL RESOLVES AND ORDERS AS
FOLLOWS:
1. The City Council elects to proceed in this matter under the provisions of the Public Streets,
Highways and Service Easements Vacation Law as set forth in Section 8330, et seq., of the
Streets and Highways Code of the State of California.
2. The date of dedication of the proposed easement is less than five years, and more than one
year, immediately preceding this resolution; and the proposed easement, which has never
been accepted by the City, has not been used continuously since the date of dedication.

3. The City Council approves summarily vacating the proposed easement, which is more
particularly described in Exhibit A and shown on Exhibit A-1 made a part hereof by
reference, SUBJECT TO THE FOLLOWING CONDITIONS:
(a) Paul and Wanda Edgren shall furnish the City of Redding with an Easement Deed as
set forth in Exhibit B made a part hereof by reference.
(b) The property owners or their successors-in-interest of Assessor's Parcel Nos. 048-
550-15,16,20,21,22 and 23, as shown on Exhibit C made a part hereof by reference,
shall have recorded—concurrent with the recording of the Easement Deed attached as
Exhibit B—property line adjustments between the area described and shown in said
Exhibit B and the adjoining parcels to extend the respective property lines to the
Sacramento River as shown on Exhibit C.
(c) The City Clerk is directed to concurrently record the required documentation in the
office of the Shasta County Assessor/Recorder, in the following order:
Fir : The Easement Deed from Paul and Wanda Edgren (Exhibit B);
ec n : A certified copy of this resolution of vacation; and
Thir : The property line adjustments set forth in paragraph 3 (c).
4. From and after the date this resolution is recorded, the proposed easement offered for
dedication shall no longer have any effect.
I HEREBY CERTIFY that the foregoing resolution was introduced, read and adopted at a
regular meeting of the City Council on the 6th day of October, 1998, by the following vote:

condition of the property and to prohibit development which would alter the floodplain, unless such development is otherwise
allowed by federal, state or local law or policy within land designated as open space. No uses, structures, or physical
