A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDDING
APPROVING THE DISPOSITION AGREEMENT BY AND BETWEEN THE
CITY OF REDDING,THE REDDING REDEVELOPMENT AGENCY,AND
EDDIE L. TROOP AND LINDA MCMAHAN AND MAHING CERTAIN
FINDINGS IN CONNECTION HEREWITH
WHEREAS, the Redding Redevelopment Agency (Agency) is engaged in activities
necessary to execute and implement the Redevelopment Plan for the Market Street Redevelopment
Project Area; and
WHEREAS, in furtherance of the objectives of the California Community Redevelopment
Law (California Health and Safety Code Section 33000 et seq.),the Agency has undertaken a project
to realign Westside Road; and
WHEREAS, the Implementation Plan adopted by the Agency with respect to the
Redevelopment Plan includes the realignment of Westside Road as means to improve inadequate
public infrastructure, allow utilization of previously undeveloped or underdeveloped land, act as an
incentive to private development to invest in the area, and to alleviate traffic congestion within the
Project Area; and
WHEREAS,the realignment of Westside Road necessitated the acquisition of land located
at 4220 Westside Road and the displacement of the Redding Veterinary Clinic at that location �
owned by Eddie L. Troop and Linda McMahan (Troop); and
WHEREAS, the Agency owns land in excess of the future realigned Westside Road right
of way at 4210 Westside Road and may have excess land at 4220 Westside Road upon completion
of the realignment project; and
WHEREAS, The City will abandon the existing Westside Road right of way for street
purposes upon the completion of the realignment of Westside Road; and
WHEREAS, the Agency, City, and Troop propose to enter into a Disposition Agreement
pursuant to which the Agency would sell the excess land at 4210 and 4220 Westside Road and the
City would deed existing Westside Road right of way upon its abandonment to Troop and as a
replacement site for the veterinary clinic; and
WHEREAS,pursuant to Section 33433 of the Community Redevelopment Law,the Agency
is authorized, with the majority approval of the City Council after a public hearing, to convey
property for redevelopment purposes pursuant to the Redevelopment Plan upon a determination by
the City Council that the sale of the property will assist in the elimination of blight and that the
consideration for such sale is not less than either fair market value or fair reuse value in accordance
with the covenants and conditions governing the sale and development costs thereof; and
WHEREAS, a joint public hearing of the Agency and City Council on the proposed
Agreement was duly noticed in accordance with the requirements of Health and Safety Code Section
33433; and �
WHEREAS, the proposed Agreement and a summary report meeting the requirements of (
Health and Safety Code Section 33433 were available for public inspection consistent with the
requirements of Health and Safety Code Section 33433; and �
WHEREAS, on September l, 1998,the Agency and City Council held a joint public hearing �
on the proposed Agreement and evaluated all of the information, testimony, and evidence presented \
during the joint public hearing; and ���

WHEREAS,the City Council has reviewed the summary report required pursuant to Health
and Safety Code Section 33433 and evaluated other information provided to it pertaining to the
findings required pursuant to Section 33433; and
WHEREAS, The sale of the property pursuant to the proposed Agreement will improve the
quality of life of the residents of the City of Redding by the elimination of blight by providing for
the reuse and redevelopment of a portion of the Project Area which formerly contained a
deteriorated commercial structure; and
WHEREAS, the value of the consideration for the property pursuant to the proposed
Agreement will be greater than the fair market value of the site as set forth in the Summary Report;
and
WHEREAS, the sale of surplus government property is categorically exempt under Section
15312 of the California Environmental Quality Act; and
WHEREAS,the City Council has duly considered all terms and conditions of the proposed
Agreement and believes that the disposition of the Site pursuant thereto is in the best interests of the
City of Redding and the health, safety, and welfare of its residents, and in accord with the public
purposes and provisions of applicable state and local laws and requirements.
NOW, THEREFORE, the City Council of the City of Redding FINDS, RESOLVES
AND ORDERS as follows:
1. The above recitals are true and correct.
2. The City Council of the City of Redding makes the following findings in connection with
the proposed Disposition Agreement:
(a) The sale of the property at 4210 and 4220 Westside Road will assist in the
elimination of blight and is consistent with the implementation plan adopted pursuant
to Section 33490 of the California Health and Safety Code; and
(b) The consideration is not less than the fair market value in accordance with the
highest and best use under the Redevelopment Plan.
3. The City Council of the City of Redding hereby approves the Agreement. The Mayor of the
City of Redding is hereby authorized and directed to execute the Agreement on behalf of the
City of Redding, and the City Clerk is authorized and directed to attest thereto subject to a
finding by the Redding Planning Commission that the disposition of the property at 4210 and
4220 Westside Road as proposed is consistent with the Redding General Plan. A copy of
the Agreement when executed shall be placed on file in the office of the City Clerk.
I HEREBY CERTIFY that the foregoing resolution was introduced, read and adopted by
a majority vote at a regular meeting of the City Council of the City of Redding on the 1 st day
of September , 1998.
