A RESOLUTION OF THE CITY COUNCII, OF THE CITY OF REDDING
SUMMARILY VACATING THE WESTERLY THREE-FOOT PORTION OF A
PUBLIC SERVICE EASEMENT FOR STORM DRAIN PURPOSES LOCATED
ALONG THE WESTERLY TEN FEET OF LOT 10, SOMERSET ESTATES
SUBDIVISION, LTNIT 3 (3683 CHERRYWOOD DRIVE, A-4-98).
WHEREAS:
l. A 20-foot wide drainage easement was dedicated to the City of Redding in Unit 3 of
the Somerset Estates Subdivision, recorded in Book 19 of Maps at page 4, Shasta County Records.
The easement is 10 feet on each side of the property lines, and the storm drain is located on the
property lines.
2 The property owners of Lot 10 have requested that the westerly three feet of the
public service easement for storm drain purposes located along the westerly ten feet of their lot be
vacated. The westerly three feet of the ten-foot easement is not necessary, nor has it ever been used,
for the purpose for which it was acquired.
3. The Public Works Department has advised the City Council that there are no in-place
public utility facilities that are in use or would be affected by vacating the westerly three feet of said
easement; and the remaining seven-foot portion of the easement is sufficient for repairs and
maintenance.

NOW, THEREFORE, THE CITY COUNCIL RESOLVES AND ORDERS AS �
FOLLOWS: �
1. The City Council elects to proceed in this matter under the provisions of the Public Streets, �
�Highways and Service Easements Vacation Law as set forth in Section 8330, et seq., of the �
Streets and Highways Code of the State of California. �

2. The westerly three feet of the public service easement for storm drain purposes located along
the westerly ten feet of Lot 10 of Unit 3 of the Somerset Estates Subdivision is not necessary,
nor has it ever been used, for the purpose for which it was acquired. The City Council
therefore approves the request to summarily vacate the three-foot portion of the easement, as
more particularly described in Exhibit A and shown on Exhibit B attached and made a part
hereof by reference.
3. The City Clerk is directed to cause a certified copy of this resolution of vacation, attested by
the Clerk under seal, to be recorded in the office of the Shasta County Assessor/Recorder.
4. From and after the date this resolution is recorded, the three-foot portion of the easement
described in Exhibit A and shown on Exhibit B and hereby vacated shall no longer constitute
an easement for storm-drain purposes.
I HEREBY CERTIFY that the foregoing resolution was introduced, read and adopted at a
regular meeting of the City Council on the 15th day of DAcember, 1998, by the following vote:
