Code §6103 APN 054-590-15 thru 23 RESOLUTION NO. 98- !G 7 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDDING SUMMARILY VACATING THAT PORTION OF A 20-FOOT PIPELINE EASEMENT FOR FORCE-MAIN PURPOSES LOCATED ALONG THE WEST BOUNDARY OF LOTS 15 THROUGH 23 OF UI�TIT 1 OF THE HIGHLAND OAKS SUBDIVISION (A-10-98). WHEREAS: 1. Through annexation, the City of Redding acquired a 20-foot-wide pipeline easement for force-main purposes, namely a Deed of Right-of-Way dated May 16, 1968, and recorded as No. 4847 in Book 986 of Official Records at page 634, Shasta County Records. 2. With the construction of the Clover Creek sewer trunk, the portion of the easement located along the west boundary of Lots 15 through 23 of Unit 1 of the Highland Oaks Subdivision, as more particularly described in Exhibit A and shown on Exhibit B attached and made a part hereof by reference, is no longer necessary. All sewer flows to the Stillwater Treatment Plant by gravity. 3. The property owner has requested that the easement along the west boundary of Lots 15 through 23 be vacated as it has not been used for the purpose for which it was acquired for five consecutive years immediately preceding the proposed vacation. 4. The Public Works Department has advised the City Council that there are no in-place public utility facilities that are in use or would be affected by vacating said portion of the easement. NOW, THEREFORE, THE CITY COUNCIL RESOLVES AND ORDERS AS FOLLOWS: � 1. The City Council elects to proceed in this matter under the provisions of the Public Streets, �i Highways and Service Easements Vacation Law as set forth in Section 8330, et seq., of the � Streets and Highways Code of the State of California. � � �����:37�9�A����� ' � � ! i 2. That portion of the 20-foot pipeline easement located along the west boundary of Lots 15 through 23 of Unit 1 of the Highland Oaks Subdivision is no longer necessary for force-main purposes due to its non-use for five consecutive years immediately preceding this vacation; and there are no public facilities located therein. The City Council therefore approves the request to summarily vacate that portion of the easement described in Exhibit A and shown on Exhibit B attached hereto. 3. The City Clerk is directed to cause a certified copy of this resolution of vacation, attested by the Clerk under seal, to be recorded in the office of the Shasta County Assessor/Recorder. 4. From and after the date this resolution is recorded, that portion of the 20-foot pipeline easement described in Exhibit A and shown on Exhibit B and hereby vacated shall no longer constitute an easement for force-main purposes.
