Code §6103 A.P.N. 071-150-36, 071-330-01 RESOLUTION NO. 98- /(� A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDDING SUIVIIVIARILY VACATING PORTIONS OF CANBY ROAD, LANCERS LANE AND BROWNING STREET PURSUANT TO CONDITIONS 4 AND 6 OF LOT SPLIT NO. LS-3-97 [A-8-98]. WHEREAS: A. Those portions of Lancers Lane and Canby Road proposed for vacation were dedicated to the City for public use (streets, drainage easements and public utility easements) on the Mt. Shasta Heights Subdivision as recarded January 19, 1977, in Book 14 of Maps at page 139, Shasta County Records. B. That portion of Browning Street proposed for vacation was dedicated to the City for public use (street and public service easement) on Parcel Map LS-10-96 as recorded July 29, 1997, in Book 32 of Parcel Maps at page 32, Shasta County Records. C. It is the recommendation of staff that the City summarily vacate those portions of the Canby Road, Lancers Lane and Browning Street rights-of-way/easements as more particularly described in Exhibit A and shown on Exhibit B attached hereto and made a part hereof by reference, pursuant to conditions 4 and 6 of Lot Split No. LS-3-97. NOW, THEREFORE, THE CITY COUNCIL DETERMINES, RESOLVES AND ORDERS AS FOLLOWS: � i l. The City Council elects to proceed in this matter under the provisions of the Public � Streets, Highways and Service Easements Vacation Law as set forth in Section 8330, et � seq., of the Streets and Highways Code of the State of California. � � Bi�i��3��F�r,cf ��1 � , • • 2. The City Council approves the request to summarily vacate those portions of the Canby Road, Lancers Lane and Browning Street rights-of-way/easements described and shown on attached Exhibits A and B, for the following reasons: (a) Those portions of Canby Road and Browning Street being vacated are excess rights-of-way not required for street purposes, and there are no public utilities located therein. (b) The southerly 30' of Lancers Lane is being vacated as the easement has not been used for the purpose for which it was dedicated for five consecutive years immediately preceding this vacation. [The northerly 30' of Lancers Lane is not being vacated, as there are in-place public utilities that are in use.] 3. The City Clerk is directed to cause a certified copy of this resolution of vacation, attested by the Clerk under seal, to be recorded in the office of the Shasta County Assessor/Recorder. 4. From and after the date this resolution is recorded, the areas described in Exhibit A and shown on Exhibit B shall no longer constitute portions of the Canby Road, Lancers Lane and Browning Street rights-of-way/easements.
