A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDDING
ELECTING TO COMPLY W1TH CERTAIN ANIMAL HOLDING PERIODS
SET FORTH UNDER STATE LAW IN EFFECT ON JUNE 30, 1999, AS
AUTHORIZED BY CHAPTER 81 OF THE STATUTES OF 1999 OF THE
STATE OF CALIFORNIA
WH�REAS, Chapter 752 of the Statutes of 1998 of the State of California, among other
things, amended or added Sections 31 108,31752,31752.5,and 31754 to the Food and Agricultural
Code setting forth certain minimum required holding periods for various animals, effective July l,
1999; and
WHEREAS, Chapter 81 of the Statutes of 1999 of the State of California allows cities that
had a contract in place for the provision of animal shelter holding services on Januaiy l, 1999, to
elect by resolution to comply with the holding periods set forth under state law on June 30, 1999,
under certain conditions; and
WHEREAS,the City of Redding(City)and the Haven Humane Society(Humane Society)
have entered into agreements under which the Humane Society has provided various animal control
and sheltering services to the City since 1982 through the present; and
WHEREAS, the Humane Society has stated to the City that the Humane Society cannot
reasonably comply at all times with the holding periods required under California Food and
Agricultural Code sections 31 108,31752,31752.5,and 31754,as added or amended by Chapter 752
of the Statutes of 1998 of the State of California, due to the lack of sufficient facilities and has
provided the City with a description of the local circumstances related to this situation; and
WHEREAS, the City desires to comply with the holding periods specified under state law
on June 30, 1999, until a plan is fully implemented to meet the holding periods set forth in �

supporting this election; and �

WHEREAS,the City desires to request the Humane Society to uti ize existing animal shelter
facilities to comply,to the extent possible,with the h_olding periods reyuired by California Food and
Agricultural Code sections 31108,31752,31752.5,and 31754,as amended or added by Chapter 752
of the Statutes of 1998 of the State of California; and
WHEREAS,the City Council desires to request that the Humane Society continue to operate
a program for the adoption of animals and to release an animal scheduled to be eutllanized to a
nonprofit animal rescue or adoption organization at the request of that nonprofit organization,all as
provided by state law, and that the Humane Society implement flexible operating hours in order to
increase the opportunity for owners to reclaim their pets and to increase the opportunity for adoption
of impounded animals; and
WHEREAS, the City Council desires to direct the City Manager to develop a plan to meet

the holding periods reyuired under California Food and Agricultural Code sections 31108, 31752,
31752.5, and 31754, as added or amended by Chapter 752 of the Statutes of 1998 of the State of
California, on or before July 1, 2000, and to bring back that plan to the City Council for
consideration and adoption within sixty (60) days from the date of this Resolution; and
WHEREAS, the City Council desires to authorize the City Manager to take any additional
actions that may be necessary or required in order to effect this election and Resolution; and
WHEREAS, the public hearing before the City Council on the proposed adoption of this
Resolution was duly noticed in accordance with applicable laws.
NOW,TH�REFORE, I3E IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF RCDDING TI-IAT:
SECTION 1. Pursuant to the requirements of Chapter 81 of the Statutes of 1999 of the State
of California, the City Council of the City of Redding hereby states that the City and the Humane

sheltering services to the City by the Humane Society since 1982 through the present.

SECTION 2.
A. The Humane Society has informed the City and the City Council hereby determines
that the Humane Society cannot reasonably comply at all times with the holding
period for animals required by California Food and Agricultural Code sections
31108, 31752, 31752.5, and 31754, as amended or added by Chapter 752 of the
Statutes of 1998, because of a lack of sufficient facilities.
B. The Humane Society has informed the City and the City Council hereby finds that
the local circumstances that form the basis of this detertnination are as follows:
1. The number of animals impounded by the Humane Society in calendar year
1997 was 10,897; and
2. The number of animals expected to impounded by the Humane Society under
the holding periods required by Chapter 752 of the Statutes of 1998 of the
State of California is 10,897; and
3. The number of animals euthanized by the Humane Society in calendar year
1997 was 7,788, and the cost of providing this service during that same
period was $41,852; and
4. The number of animals adopted or reunited with their owners through the
Humane Society in calendar year 1997 was 3,001, and the cost of providing
these services during that same period was $60,920; and
5. The percentage of cage space predicted by the Humane Society to be needed

in order to comply with the holding periods required under Chapter 752 of
the Statutes of 1998 of the State of California is One Hundred Percent
(100%).
SECTION 3. The City Council desires, and hereby directs the City Manager to,develop a
plan to meet the holding periods required by California Food and Agricultural Code sections 31108,
31752,31752.5,and 31754,as amended or added by Chapter 752 of the Statutes of 1998 of the State
of California on or before July 1, 2000. The City Council hereby further directs the City Manager
to includc in that plan a schcdulc of implcmcntation of the plan and an idcntificati�n�f thc fiindin�
sources for any facilities that may have to be built in order for the City to meet these holding period

requirements. The City Council further directs the City Manager to bring back that plan to the City
Council for consideration and adoption within sixty (60) days from the date of this Resolution.
SECTION 4. The City hereby requests the Humane to utilize existing and any new animal
shelter facilities to comply, to the extent possible, with the holding periods required by California
Food and Agricultural Code sections 31108, 31752, 31752.5, and 31754, as amended or added by
Chapter 752 of the Statutes of 1998; and
SECTION 5. The City Council hereby directs the City Manager to include in any new
agreement for sheltering services with the Human Society:
A. Direction to the Humane Society to operate a program for the adoption of animals;
and
B. Direction to the Humane Society to release an animal scheduled to be euthanized to
a nonprofit, as defined in Section 501(c) of the Internal Revenue Code, animal
rescue, or adoption organization at the request of that nonprofit organization, as
provided by state law; and
C. A requirement that the Humane Society implement flexible operating hours in order
to increase the opportunity for owners to reclaim their pets and to increase the
opportunity for adoption of impounded animals.
SECTION 6. The City Council hereby authorizes the City Manager to take any additional
necessary actions to effect this election and the actions contemplated under this Resolution
